Tax Garnishments, Collection Issues, and Offers in Compromise
Georgia Tax Garnishments, Collection Issues, and Offers in Compromise
Often when the tax man cometh, he does so with an iron fist and a hammer. Frequently in striving to address tax issues, situations frequently worsen before they can get better as it takes time for items to be “worked through the process.” This is a sample letter that might be used when the state of Georgia is pursuing aggressively collection methods including a garnishment. Working with a CPA is your best course to ensuring that you pay only the taxes that you owe while ensuring that any penalties that might be abated are done so, using your rights as a taxpayer to your advantage.
Georgia Department of Revenue, Installment Payment Unit
Enclosures: GA Form 9465 (Installment Payment Plan Application)
Dear Sir or Madam,
Please cease all garnishment efforts on the above referenced client. A garnishment will be a financial blow to the clients that I do not anticipate they will be able to recover from to address both their Georgia monies owed as well as the federal Offer of Compromise that is presently pending in the IRS Appeals Office.
I am following up on the taxpayers open monies due the state of Georgia and to set up an Installment Agreement thereon. I have previously forwarded for your review a copy of the last piece of correspondence regarding their IRS Offer in Compromise. As you can see from the correspondence the taxpayer has no substantive assets, cash flow or funds of any type. This is the most they are able to commit to at this time. Accordingly, please cease all garnishment efforts while this Installment Agreement is being processed.
I have previously forwarded GA Form 9465: Installment Payment Plan Application for the above referenced taxpayer listing the most that they would be able to commit to on an monthly basis as $100 per month. In this package the client has been able to commit to having a $325 monthly payment. Accordingly I have asked the client to send a check for the first monthly payment by 9-1-09. The taxpayers are desirous to settling all of their tax debts and this will be a positive step in that direction.
Please accept this Installment Plan as originally forwarded. Please do not hesitate to contact me if you have any questions or need any additional information.
Sincerely, John C. Dillard, CPA, PC, Partner in Charge
