God gives us guidance on how to respond to life’s opportunities as well as its problems.
The Top Two Tax Problems when dealing with IRS tax issues are:
1. Addressing what caused the problem. Whether it be unwillingness/inability to file. Whether it be one of omission or of accident. Whether it be due to lack of retaining a good CPA or lack of knowledge.
2. Failure to respond. Just this past month I have had clients receive garnishments and a Tax Summons as the IRS’s response to a taxpayer’s unwillingness to address a tax problem making a situation bad, much worse and limiting a taxpayers options to responding and reacting to IRS Enforced Collection Issues limiting your options to address back tax returns and unpaid tax liabilities.
So when that IRS notice arrives, look for a CPA to address your IRS representation issues. The below is a sample letter we might use to send to a client to begin the process of addressing IRS representation issues and to get all un-filed back tax returns, filed ASAP:
We need to Get From You a Signed Power of Attorney/IRS Form 2848
Copy of the last filed corporate and personal income tax returns
For all non-filed corporate tax returns copies of all filed payroll tax returns and recaps of all payments made by year.
I suggest that we work to get all of the corporate returns filed first and then the personal as per your advice your are an S Corporation and file IRS Form 1120S.
This is to confirm my advice that I suggest we do one tax year at a time.
I suggest you commit to a firm timetable to get all of your non-filed corporate and personal returns done so that I might notify the IRS and GA accordingly. The smaller the time period you commit to and achieve the more apt we will be to avoid further forced collection issues. I suggest a timetable of no longer than thirty to forty days.

Due to the volume of work to be done forwarding of a retainer, I suggest between one to three thousand. This is to confirm that all of our time will be billed at our standard hourly rate of $195/hour and that both the IRS and GA are substantially impaired by tax law to effectively address open tax monies (unless you opt to full pay) until all of your tax returns are filed and current.
I suggest you recap your corporate data using an accounting package such as Quick-Books or if need be the form that is listed on the contact page of my website, while being sure to list the beginning and ending checkbook balance so you will be sure to have included all of the transactions that occurred in the business account.
