Atlanta CPA Provides IRS Audit/Back Taxes Consultations & Advice 

When getting ready for an audit the first best call is to a well experienced CPA to ensure that both your rights but more importantly that you return is correct and prepared to best ensure your lowest legal possible tax. As a Body of Believers, though we are to submit to Authority, we are not required either by tax law or by our faith to pay more than our fair share and therefore just and legally liable tax obligation/bill. 

All correspondence with the IRS should be an ends to an mean and help to encourage the client, the IRS and their agent to close their file as quickly as possible, while ensuring that you pay only your legally liable tax. To that end I have provided the below sample audit letter detailing what we did, the terms and even enclosing the check to pay the taxes and interest in full while asking for penalty abatement. For the easier a CPA can make it on the agent to adequately and efficiently close their file is a win for both the IRS and the client.

I am writing you in a good faith attempt to come to terms over the above taxpayers’ present predicament and to address their tax issues.  I am willing/eager to supply you with any information that you might need in order to process the audit. I have worked with the client to get their tax filings correct for the _____ tax year and payments current ASAP. To that end I have prepared for you a Form 1040X for the _____ tax year.  

Enclosed please find a check for $____ to be applied as follows:

With the payment of the tax and interest in full I am asking that the IRS abate any assessed penalties. Since I have assumed their role as their CPA, they client has asserted their intent to keep their tax filings and payments current.

I believe the penalty abatement is a just request as I believe the IRS is a fair institution designed to help taxpayers pay their just taxes. 

I appreciate your attention to this matter and look forward to working with you to close their file.

IRS Representation is perhaps the most important and sensitive of all tax functions that a CPA can provide. Recently we received the below inquiry regarding addressing time sensitive IRS/Georgia Tax Representation issues: 

Couple more questions, this guy with the state seems angry and has stated that HE is the last one to be notified when drastic action is about to happen.  If we acquire your services, will there be a (30) day…temporary stay on our case or will we be “”protected” a little longer???  I just don’t want this guy to find out we’ve hired a 3rd party to help us and then he turns around and takes position of whatever he can get.  Thanks for your time on this.

Like Nehemiah in the Old Testament we are to be both thoughtful, insightful and full of preparedness as you ready yourself to submit an Offer in Compromise. Rather than “throwing paper at the IRS” it is prudent to spend an adequate amount of time and planning to ensure that you have an Offer that is able to be accepted, and not rejected because of its failure to consider all of the many and varied rules and regulations of successful IRS Representation and Offer in Compromise acceptance. It is always prudent to explore all of the available and appropriate options before rushing to submit and Offer in Compromise that is not processed. Below is a sample inquiry we might receive and the following, our response:

I know when I originally talked to you earlier this year, we talked about offer in compromise.  At that point you didn’t have 2010 to look at.  Now that we know there is such a large loss for 2010, we know that personally and in the business we have more liabilities than assets.   Surely we qualify based on our 2010 situation.  Yes, we’ve paid ourselves substantial salaries, but the net effect of our business against those W-2s still means a negative or break even situation. We have no borrowing power because our credit is so low.  We have no cash flow that exceed our needs to finance our business needs. 

We are desperate at this point.  We’d like to offer $10,000 as an offer in compromise.   

 

Below is my response: 

Below are the general rules and guidelines to consider submitting an Offer in Compromise. If you after you both review the below and feel you qualify, please get to me ASAP your year to date 2010 internal financials and  Form 433A. If you look like a candidate based upon that information then I will need you to complete Form 433B and Form 656. FYI, you can print off all these forms off the IRS web site. 

Offers  in Compromise to the IRS and/or the state of Georgia is a proposal on your part to pay only a portion of the back income taxes you owe. If the offer is accepted, the remainder of the tax debt will be forgiven. For individuals or corporations with significant tax problems, an IRS offer in compromise can eliminate tax obligations much the same way as filing bankruptcy can eliminate personal or corporate debt.

The IRS has specific rules that must be followed when submitting an offer in compromise, including:

  • All tax returns and forms from prior and current years must be submitted
  • You must be paid up on all current year tax obligations, including estimated tax payments
  • The amount you propose to pay must be reasonable, based on your net worth and estimated cash flows for the next several years
  • If the IRS accepts your offer in compromise, you will be required to stay current on all personal and corporate tax obligations for the next five years.

Offer in Compromise Submission

Although clearly no one desires to be audited as both the administrative burden and potential economic burden of an audit are more than enough to be considered as well as the emotional stress. However, I believe all clients should never not take a deduction they are legally entitled to as otherwise they are overpaying their taxes and paying more than their fair share. However, in serving the truth, we can trust that the truth, regardless of an audit environment or not, will indeed set us free. However if you find yourself facing an IRS audit or needing IRS Representation retaining a CPA if your best first step to ensure that you only pay what you legally owe. Below is a sample letter that might be used if a client inadvertently failed to include and represent open payroll taxes, which were failed to be included and communicated in an Offer in Compromise to the IRS.

Please cease all collection efforts on the above taxpayers as am working to submit an Offer in Compromise to address all of the open monies due on their account.I am writing you in a good faith attempt to come to terms over the above taxpayers’ present predicament with the IRS  I am willing/eager to supply you with any information that you might need to close your file. I plan to submit and Offer in Compromise on the above referenced taxpayers ASAP after I can get the payroll taxes assessed to them personally as the responsible party. Their original Offer in Compromise inadvertently did not include their monies so that Offer is being rescinded. ASAP after the payroll taxes/Civil Penalty is assessed the above taxpayer personally as the responsible party an Offer in Compromise will be submitted including these monies. 

In the interim please be advised that the taxpayer now works another employer and that they are accordingly paying her ongoing income taxes there via payroll withholding. 

The above taxpayers have advised me that they have filed all of their presently due tax returns. I believe that this shows they want to continue as taxpaying citizens and to begin actively paying taxes as they are owed. Please note the taxpayers  recently paid the IRS an estimated tax payment of $10,000 to bring their current tax payments current.  

It is my goal to help in their efforts to return to compliance. Since I have assumed the role as their financial advisor (they had no advisor previously), I have consulted with them, and in good faith I would like to make and Offer in Compromise for the taxpayers to pay as much of the balance of the tax liability as they possibly can.   

Please note that I have advised the taxpayers that after the acceptance of their Offer that they must stay in compliance by keeping all of their filings and payments current for five years.  They have further been advised that in the event they do no maintain the above that the previously accepted offer would be voided and the previously abated monies would be reinstated and collection efforts resumed.  

Please cease all collection efforts while this Offer is being re-submitted.  I appreciate your attention to this matter and please do not hesitate to contact me should you have any questions.

Gwinnett CPA Teaches  Getting Your Business’s Internal Financials Ready for an Audit, IRS Representation Issues or Submitting an IRS Offer in Compromise

Although it is tempting to address a crisis only when it arrives, it is much more prudent to be aware and ready for events before they come issues for failing to prepare, is preparing to fail. However it is often when a client has been called to task on an audit or is considering submitting an Offer in Compromise when a CPA can especially be invaluable in readying for the tasks at hand. Like a good general, the first task of a CPA in representing a corporate or personal tax return is to assess the damage, understand the whole of the tax environment and nuances thereof, control the communication with the IRS/taxing authorities, and to plan a strategy that works best for the client. Care needs to be exercised to ensure that a well-thought out plan needs to be tailored to that particular client to ensure a successful IRS audit experience. Below is a sample of a letter that might be sent to a client to coordinate the many and varied tax issues to ensure no important items are missed or ignored.

I just received statement for the open monies for the 2006 to 2008 showing $120,000 outstanding, including taxes penalties and interest due and payable to the IRS. Time, when dealing with the IRS, is not our ally. It is critical that we get all of your tax filings and current payments, for the 2009 tax year, ASAP. Failure to do so can/will result in two potentially worse negative tax issues than before:  

-The IRS is not statutorily allowed to work with a taxpayer to either consider/process an Offer in Compromise or an Installment Agreement unless a taxpayer is current on all of its current year responsibilities and payments.

-Tax fines and penalties along with its attendant interest continue to be accrued until the manner/open balance is either paid is full or formally abated. 

ASAP please forward me a copy of your filed 2009 corporate and personal income tax returns so that I might review it for any potential errors or deficiencies. We have often helped taxpayers to legally amend their corporate and personal income tax returns to correctly claim previously missed deductions resulting in the refund of thousands and thousands of dollars. 

I suggest that ASAP that you complete IRS Form 433A, Form 656 and Form 433B (if applicable) so that we might evaluate if you are an candidate to submit an Offer in Compromise. Failing to respond to IRS notices ASAP can expose you to additional collection efforts by the IRS including levies, liens, asset seizure and garnishments, which otherwise might be avoided by quickly, efficiently, and effectively addressing IRS notices received. 

If you are not a candidate for an Offer in Compromise I suggest that either ASAP you pay the tax and interest in full, while asking for penalty abatement or get on an installment plan. 

Please be sure your internal 12-31-08 Balance Sheet equals the Balance Sheet on page Four of the Corporate Income Tax Return/IRS Tax Form 1120S. In this way we will know that your 2009 internal financial statement is starting off with the correct balances, as they are listed on the corporate income tax return.

The taxpayers are an ideal candidate for an Offer in Compromise as they have no substantive liquid assets. I have suggested that they borrow as much as possible from their friends and relatives. With great difficulty, they have arranged to borrow an amount that exceeds their personal net worth. They have arranged to borrow these funds after the acceptance of their Offer in Compromise. These monies would otherwise not be available as evidenced by the enclosed forms. Therefore, I believe this to be a fair and reasonable offer.

When you are readying yourself for IRS Representations Issues, Getting an Installment Plan Established, or when submitting an Offer in Compromise it is prudent to be aware of have already assessed to the taxpayer any and all 100%/Civil Penalties so that your Taxpayer Advocate/CPA does not have to handle critical and essential tax issues twice. Below is a sample of a letter that might be used to have the IRS assess the responsible taxpayer penalty to ensure that all monies “are on the table” and that otherwise addressable issues do not spoil an otherwise positive IRS representation experience. For example, finding there are other unpaid taxes will void an Offer in Compromise, Installment Plan and a payment strategy to address otherwise potentially solvable issue.

ASAP after these monies are assessed I plan to  submit an Offer in Compromise on their behalf.  I am willing/eager to supply you with any information that you might need in order expedite assessment of the 100% Penalty/Civil Penalty.

Also when you are assessing these monies please send to me  copies of all assessments while ensuring that we have a list of all outstanding payroll taxes for the company.

Anticipating questions before they are asked by the IRS, knowing what to expect and developing both reasonable expectations with both the Internal Revenue Service and a client are essential to successful dealings towards handling IRS tax representation issues and tax advocacy. When the IRS heightens their collection efforts, it is usually one of the predominant factors in helping taxpayers realize the importance of the needs to quickly address open tax issues that are getting higher as additional penalties and interest are incurred. Also the added impact of the IRS enforced collection efforts assist in heightening a taxpayers financial sensitivity as tax liens affect their credit and ability to handle their business and personal affairs, tax levies seize bank account monies, and garnishment affect both W-2 wages and independent contractor income. Dear Sir or Madam,

I am sending this to you in a good faith attempt to come to terms over the above taxpayers’ present predicament and to submit an Offer in Compromise on their behalf. I am willing/eager to supply you with any information that you might need in order to process the Offer.

 The taxpayers have advised me that they have filed all of their presently due tax returns. I believe that this shows they want to continue as taxpaying citizens and to begin actively paying taxes as they are owed. Please note I have enclosed copies of where they recently paid the IRS an estimated tax payment of $5,000 to bring their current tax payments current. Please note the taxpayer on September 1, 2009 incorporated their business as ABC Company, Inc. and has retained a payroll service to ensure that their withholding taxes are paid as they become due.

In an effort to help in their efforts to return to compliance. Since I have assumed the role as their financial advisor (they had no advisor previously), I have consulted with them, and in good faith I would like to make and Offer in Compromise for the taxpayers to pay as much of the balance of the tax liability as they possibly can.

 As they have no substantive liquid assets, I have suggested that they borrow as much as possible from their friends and relatives. With great difficulty, they have arranged to borrow an amount that exceeds their personal net worth. They have arranged to borrow these funds after the acceptance of their Offer in Compromise. These monies would otherwise not be available as evidenced by the enclosed forms. Therefore, I believe this to be a fair and reasonable offer.

Note that I have advised the taxpayers that after the acceptance of their Offer that they must stay in compliance by keeping all of their filings and payments current for five years. They have further been advised that in the event they do no maintain the above that the previously accepted offer would be voided and the previously abated monies would be reinstated and collection efforts resumed.
