Below is a sample inquiry we might receive from a client to address their tax planning issues for both 2009 & 2010. At His CPA PC we strive to provide quick, correct and dependable answers to that you might both pay your lowest legal possible tax and avoid unnecessary fines and penalties. The sample inquiry is regular font and my response in ALL CAPS:

Hello John, 

First off, Happy New Year and thanks as always for your support.  It’s much appreciated. 

I see the payment arrived to you last year.  I now have fully paid my 2008 taxes and have my US account balance ready to fund the next projects. Before I send you another payment, I ask that you give me an estimate to complete the following jobs therefore I can send you a payment that covers the jobs and / or decide to forgo certain items for later. 

1.  My income in 2009 was reduced by the economic crisis so that my earnings were actually less than in 2008.  Can you estimate my taxes due for 2009 based on that lower income so I can start sending payments to the IRS (and perhaps re-do the form I should use and PDF it to me by email). THERE SHOULD HAVE BEEN IN THE PACKAGE WITH YOUR RETURNS THE IRS FORMS 1040ES TO PAY 2009, IF YOU HAVE NOT PAID THEM YET, THEN I SUGGEST ADDING ALL FOUR OF THE AMOUNTS AND PAYING IT BY THE 1-15-10 DUE DATE OF THE FOURTH 1040ES FOR 2009. IF FOR ANY REASON THEY WERE NOT IN THE PACKET OR YOU HAVE SET THEM ASIDE, GO TO IRS WEB SITE AND FIND FORM FOR 2009 AND PAY AT LEAST AS MUCH AS THE 2008 TAX BILL. 

Next requests which I ask you to estimate rough costs. 

2. I have stock options that will start to expire at the end of 2010 that of today are worth approximately $60K.  I would like you to study my situation and recommend a tax strategy, noting that my goal when I exercise the options is to move the funds into some kind of retirement savings that would allow me to avoid taxes if possible. TAX LAW SAYS IF WE MEET CERTAIN TAX WITHHOLDING RANGES THEN THE IRS WILL NOT ASSESS A PENALTY. WE CAN LOOK TO WORK WITH A FINANCIAL ADVISER TO BEGIN TO SET ASIDE MONIES FOR YOUR RETIREMENT. LET ME KNOW SOMETIMES THAT WORK FOR YOU AND WE CAN ARRANGE A CONFERENCE CALL AND WITH YOUR PERMISSION I CAN SHARE WITH THEM YOUR RETURN DATA. PLEASE GET WITH YOUR EMPLOYER ON THE OPTIONS AND DETERMINE WHAT WILL BE THE TAXABLE AMOUNT. THOUGH TAX LAW MAY ALLOW YOU SOME EXCEPTIONS AND DELAY IN PAYING THE TAXES ON THE OPTIONS IN 2010, I RECOMMEND THAT WE PAY ALL OF THE TAX AS IT IS EARNED. IN THIS WAY YOU WILL NOT HAVE THE EXPOSURE OF ANY PENALTIES AND WE ALSO WILL NOT BE LULLED INTO A FALSE SENSE OF SECURITY IN YOUR BELIEVING YOU ARE CASH FLUSH WHEN IN REALITY MUCH IS STILL OWED, DUE AND PAYABLE TO THE IRS. 

3 Clean up of the GA tax situation.  It seems to me that the situation is just about cleaned up but I would also like that if my credit record is tarred by any liens issued against this illegitimate claim of back taxes, that the credit record gets duly cleaned up, or at least a note is added explaining that I never owed the money and it was a mix-up). I WILL BE HAPPY TO DO WHATEVER YOU WOULD LIKE FOR ME TO ATTEMPT WITH GA TO WORK TOWARDS WHAT ALL WOULD CONSIDER A FAIR AND JUST DETERMINATION. 

AN ESTIMATE OF THE BILLING FOR #2 WOULD BE TWO HOURS AND ON NUMBER #3 WOULD DEPEND ON HOW LONG YOU WANT ME TO PURSUE AND HOW LONG THEY WILL TAKE TO ADJUST AND CORRECT. I WOULD HOPE THIS COULD BE DONE IN THREE TO FIVE HOURS.

At His CPA PC you will never be just a client. We believe in practicing the Golden Rule at every step of the way. Though at times this takes much more time than just being “fair” as the world sees it, it is WWJD (What Jesus Would Do). Below is a sample note we have received:

Wow John, I’m impressed….an email letting me know you remember me….which may or may not be good considering my history. well and up to date note.  My husband and I are divorced and he has 100% controlling interest in the company he literally stole from me. no hard feeling though, he incurred all the debt and ran the books into the ground and now he has to dig himself out.  I, in the meantime, have started a new job. Recently I had the opportunity to meet with one of our best clients to assist with pulling their information together in order to prepare their income taxes. As a CPA we serve both their business/corporate income tax returns as well as their personal and are very involved in ensuring that every single client, every single time, receives every legal deduction available. Below is a letter we recently received after such a meeting:

I tried to use the list you wanted initially but I could not see how I could put everything into those categories.  I will begin in a week to start my posting on ledger sheets monthly and have those as the titles for each.  Then we can see if that will work. My mother did that for years as a bookkeeper.  Everything worked out fine.

Net Operating Loss Carry-backs and Net Operating Loss Carry-Forwards

Atlanta CPA on Helping Georgia Taxpayes Understand & Utilize Net Operating Loss Carry-backs and Net Operating Loss Carry-Forwards

 

Tax law has long allowed individual taxpayers to carry back and to carry forward tax losses to offset reportable income in other years. Thus if a taxpayer has a business loss that is reflected on a return they can carry these losses either back for forwards thereby legally sheltering income and creating refunds that would otherwise not exist. Net Operating Losses (NOL) are opportunities for taxpayers who have paid taxes in one year to legally offset these monies against NOL’s. Generally speaking a NOL is defined as the extent that allowable expense exceed deferred income and are carried back, by the taxpayer, two years or carried forward twenty years.

 

Claiming & Deducting a NOL Carryback

If you are individual taxpayer you can carry back your NOL, by using either Form 1045 or Form 1040X to claim your refund. You will get your refund faster by using Form 1045, but you have a shorter time to file it. You can use Form 1045 to apply an NOL to all carryback years. If you use Form 1040X, you must use a separate Form 1040X for each carryback year to which you apply the NOL.

Generally, you must file Form 1045 on or after the date you file your tax return for the NOL year, but not later than one year after the end of the NOL year. For example, if you are a calendar year taxpayer with a carryback from 2008 to 2006, you must file Form 1045 on or after the date you file your tax return for 2008, but no later than December 31, 2009

Claiming & Deducting a NOL Carryforward

If you carry forward your NOL to a tax year after the NOL year, list your NOL deduction as a negative figure on the Other income line of Form 1040.

Corporate Taxpayers

Corporate Taxpayers (C Corporations) are also eligible to utilize the IRS’s Carryback and Carryforward rules and can use Form 1139 which is a Corporate Application for Tentative Refund.

How To Claim an NOL Deduction

If you have not already carried the NOL to an earlier year, your NOL deduction is the total NOL. If you carried the NOL to an earlier year, your NOL deduction is the NOL minus the amount you used in the earlier year or years. NOL’s when carried back to prior years should be applied to the oldest return first and then carried forward. Below you will find an example of a client letter when we applied IRS tax rules and regulations and carried a loss back to prior years receiving thousands in refunds the client did not know they could claim.
