<p><strong>At His CPA PC we work hard to keep your tax bill as low as legally possible. The below is a sample letter we might receive from a client seeking wisdom about the taxes for their children who are full-time college students:</strong></p>
<p><strong>Hello John, I hope you are doing well. Our son is in school in New Jersey and is working an internship up there this summer. He got his first paycheck and got hit with the reality of taxes! </strong></p>
<p><strong>I am wondering if there is any way he can minimize his withholding. Can he adjust that so he has less federal tax taken out? I want to be sure we don’t break any rules. We still claim him on our taxes while he is a full time student. </strong></p>
<p>Below is my response:</p>
<p><strong>Withholding is based upon how he completes his withholding forms. For my daughter I encourage her to pay a little more as she goes so that at the end of the year she does not owe any. </strong></p>
<p><strong>However if you are confident your son will owe none at the end of the year I believe the payroll withholding instruction forms will walk you through how to lower his withholding as a student. </strong></p>
<p><strong>Be sure when you file your personal returns, if he still qualifies, that if you claim him as a dependent on your return that he does not also claim herself on his. </strong></p>

<p>I was given this suggested topic and title one of our members so I thought I would give it a shot. My answer to this question is &#8220;No&#8221; and &#8220;in a way&#8221;. No referring to the first half of the question and in a way to the second half. I think I will address the second half first.</p>
<p>I can say that sin is definitely killing you if you have not accepted Jesus Christ as your Lord and Savior! It does not make any difference if you are the best person in the world. Best or being good is just not enough to outweigh the Sin of not accepting Jesus for who He is, the Son of God. After His ascension, Christianity became all faith based. You must be a believer. Next, and probably as bad as not being a believer at all is developing the &#8220;I&#8217;, &#8220;Me&#8221;, &#8220;We&#8221;, and &#8220;Us&#8221; syndrome. Especially here in America there seems to be an innate belief that our achievements were accomplished solely on our own abilities. In reality we can do Nothing on our own. Everything we achieve we can do only through the talents given us individually and corporately by God Himself. By not giving The Father all the praise and glory for what we accomplish, big or small, is a very deadly sin. Finally, on, is sin killing you (me), we are descendants of the original sinner, Adam, therefore we will always sin. We all have that ability to be &#8220;stiff-necked&#8221;, one of my favorite biblical terms, at various times. Satan loves when we get this way because it gives him a foothold to work his evil in our lives. Yes sin is killing us, but praise to the Almighty, the Only Living God, we have a way to win the battle.</p>
<p>Now for the first half of the question. No, I (we) do not have the ability to kill sin. Jesus Christ was, is, always will be the only One to ever defeat sin. Now having said that, we do have an avenue to have our sins hidden so to speak and that is Christianity. Christianity is not just being spiritual, leading a moral life, or obeying God. Christianity is Power!!!! As Eph. 6:10-17 says, &#8220;Be strong in the Lord and in His mighty power.&#8221; By putting on the full amour of our God, we can stand firm on the ground against the evils of Satan. Through Him we wear the Belt of Truth, the Breastplate of Righteousness. We are protected by the Shield of Faith, wearing the Helmet of Salvation, wielding the Sword of the Spirit, which is the Word of God. This is the Power of Christianity, our only defense against sin, our only way of letting God the Father, God the Son, and God the Holy Spirit kill the sin in our lives of the past, present and future.</p>
<p>I am a sinner, and will always be a sinner in this world. I put ALL my hope in my advocate, Lord Jesus Christ at the right hand of God, and hopefully ALL my talents at the disposal of God the Father&#8217;s advocate, the Holy Spirit. It is through the Holy Trinity that I will overcome the sin in my life and through His grace and mercy, I will become a child in His Kingdom. All the praise and glory be to Him.</p>

<p>Should You File Your Return Single?</p>
<p>Should You File Your Return Married Filing Jointly?</p>
<p>Should You File Your Return Married Filing Separately?</p>
<p>Should You File Your Return as Head of Household?</p>
<p>These simple guidelines will help you determine your filing status and give you a leg up on understanding the nuances of what tax filing status you can legally claim on your personal return. There is much confusion over what is allowable in making these determinations and the below overview will do much to erase many of the existing mystiques surrounding the proper status and therefore the correct filing of your personal return.</p>
<p><strong>Single -</strong> Only taxpayers who are single on the last day of a tax year may claim single status. It does not matter what your marital status is on the first 364 days of the year but only what is your status on the last day of the tax year/December 31st, which is the key determining factor. A taxpayer who is married on the last day of a tax year cannot claim single status regardless of whether they want to file a return without their spouse.</p>
<p><strong>Head of Household -</strong> To qualify as filing as head of household a taxpayer generally must have a dependent child who lives with them throughout the year. However a single taxpayer who is allowed by a divorce decree to claim a child as a dependent, but the child does not predominantly live with them, does not qualify for Head of Household Status. Conversely, a child who predominantly lives with a parent for most of the year, can still claim Head of Household Status even if the decree specifies the other parent to be eligible for the dependency exemption in a given year. Generally speaking, married individuals with dependents who do not live with their spouses for the second half will also qualify for Head of Household status. The Head of Household tax rate is the second lowest behind the tax rates of those who are married and filing a joint return.</p>
<p><strong>Married Filing Jointly &amp; Married Filing a Separate Return-</strong> Taxpayers who are married on the last day of the year must file as either Married Filing a Joint Return, Married Filing Separately, or Head of Household (see above). Generally speaking it us usually most advantageous to file a joint return if one can, as most often the aggregate tax bill will be lessened and the attendant reporting less due to the filing of one return vs. two. You will want to keep in mind that the Married filing a joint return is the lowest of the overall tax rates/brackets and that Married Filing Separately is the most expensive/highest tax brackets.</p>
<p>Please be reminded these are general guidelines only and that you should work closely with your CPA to determine which filing status you are able to claim to ensure you fully understand and qualify for the status you will be claiming.</p>

<p>The tax recording for and the claiming of itemized deductions on your personal income tax return has been a &#8220;hot-bed&#8221; of consternation for both taxpayers and the IRS alike. Often one of the deductions that the IRS will evaluate when auditing a return, it is prudent as with all areas of tax law to understand the nuances and to record them appropriately Form 8283: Noncash Charitable Contributions. I believe that much of the confusion that exists is a taxpayers misunderstanding of the law.</p>
<p><strong>Tax Filing Requirements for Contributions</strong></p>
<p><strong>-Scope</strong>. Tax law allows you to claim deductions below a certain threshold to claim these items on Schedule A as an itemized expense on your personal return. This threshold is updated and adjusted from time to time by the IRS, but a present this amount is set at $250. If you give property contributions to charities in excess of this amount, then you are required to also complete Form 8283, as an attachment to your personal return. When preparing Form 8283 claiming Non-cash property contributions to charities of over $5000 you are required to have a signed and dated receipt from the charitable organization detailing items that you donated, by item, with the respective value for each item as a part of the tax return. It is not sufficient to have solely a total for the items given.</p>
<p><strong>-Donee Information.</strong> Generally the information listed would be the name and address of the organization, a description of the donated property, the date of the contribution, the date the items donated were originally acquired and how (purchased, gift, will, etc.), the taxpayers basis (generally original purchase price), the fair market value of the items donated and the method that us used in determining the valuation of the donated items.</p>
<p><strong>-Valuation.</strong> This is perhaps the most misunderstood portion of the law surrounding claiming a deduction for Non-cash/property contributions to charities. If you donate general household items such as clothing, books, appliances, furniture etc. they are required by IRS Rules &amp; Regulations to be valued at what they are presently worth. For example, if you bought a bedroom suit, for which you might have paid many thousands of dollars, its fair market value, if you were to re-sell it would be only a fraction of the original purchase price. Valuations of household items and furnishings, when donated to a charity should be listed at what you would be able to sale an item for at a flea market or at a thrift store. The property contribution claimed on your income tax return should not be the list price at a flea market/thrift store but what you believe the item would actually sell for, which is the best indication of value. This is when a willing buyer and a willing seller agree to a mutually agreed on price; thus fair market value. All individual items over $500 donated are required to have an appraisal to substantiate the deduction. <p><strong>Appreciated Assets</strong>. If you have an appreciating asset, it is often a wise tax-planning tool to consider giving these appreciated assets to the IRS. If you do so, then you are able to legally avoid paying a gain on the sale of the assets. For example, is some years ago you purchased a piece of land for $100,000 and through the years it has appreciated in value bringing its market value to $300,000 you can donate the land to a 501(c)/charitable organization and claim as a tax deduction the full value, or $300,000, on your personal return. Although the actual amount you can receive benefit, as an itemized deduction, is limited to 50% of your AGI/Adjusted Gross Income, you can forward any excess forward to future years, in accordance with IRS tax law. Then if the charitable organization can then in turn, sale the property themselves and use the proceeds as they wish within the confines of their 501(c). This is a great advantage for all, as you are able to claim a tax deduction for the full $300,000, the charitable organization receives the benefit or the proceeds/use of the asset. Also, the taxpayer would be able to legally avoid paying either short or long term capital gains (depending on the term/length of your holding period/how long your owned the asset). For example, if they had held the land for over a year and would be subject to paying capital gains rates of 15% on the sale of the land, if you sold it yourself. Accordingly, you would owe $30,000 on the sale ($300,000 sales price less tax basis in land of $100,000 times the 15% tax rate). If in turn you gave the after tax proceeds to a non-profit you would gain a tax deduction of only $270,000 ($300,000 sales price less the $30,000 of taxes owed).</p>
<p>Tax law, surrounding the claiming of Noncash Charitable Contributions is in a constant state of flux. Being aware of the rules and regulations at the time of a substantive donation is essential to claiming, receiving and assuring the full tax benefit of any items property contributions donated to a charity.</p>

			<content:encoded><![CDATA[<p>Duluth Gwinnett CPA: Let&#8217;s Roll</p>
<p>This time next month, we will be getting on a plane to head home from what I hope and pray is the most meaningful, memorable, exhausting, exhilarating experience of your life. Up to this point, we have been diligently working on the food order, the vans, the hotel, the flights and transportation and getting the houses and school ready for our arrival. Team leaders have been working hard to organize their part of VBS, senior center, construction, women&#8217;s and men&#8217;s bible study, teen camp and kitchen. Melarie has been working on her end getting posters put up and fliers handed out to the PP community and drives in every Sunday to clean the houses so that they will be ready come July 6th. There have been many who have spent the last few months gathering donations and reaching out to community to get help to make this trip possible and who have helped with school supplies and baskets and bibles, so that we have things to give the Navajo people. To all of you who really stepped up following our last plea for help with financial donations and gift donations &#8211; THANK YOU! I&#8217;m blown away at how giving people are.</p>
<p>Thank you to everyone who has decided to be obedient to God&#8217;s tug at your heart and is going on this trip. I have no control over how/when/where you see God on this trip and in this team, but I will tell you, the more open your heart, your mind, your eyes&#8230;the more you will benefit from this trip. Yes, we are going to serve and be the hands and feet of Christ, but we have never left the reservation without everyone feeling as though they were blessed far beyond the blessing that we left the Navajo people with. As you pack your bags, say goodbye to family and friends, do the most important thing&#8230;stop, meditate, sit alone with God and let Him talk to you, let Him prepare you and your heart, let Him guide you and comfort your fears and anxieties&#8230;seek Him with every fiber of your being over the next month and make it a point to spend at least 5 minutes with Him a day. We will be busy, we will be crazy busy at times and we sometimes lose sight of why we are there because we hit &#8220;service mode&#8221; but make it a point to find a quiet time each day on the reservation to praise Him to pray to Him&#8230;my personal favorite is sunrise &#8211; it can&#8217;t get any quieter or any more beautiful than sunrise on the reservation!</p>
<p>Your encouragement partner needs your prayers now &#8211; it is very important that we all pray for each other. Please add them to your daily vocabulary at this point and pray for them every time you think about it. We can&#8217;t make it without prayer!</p>
<p>Have a great weekend and a great Fathers Day!!!!!!! Get ready &#8211; the time to go will be here before you know it!</p>

<p>When we get new clients, like a doctor we do diagnostics and evaluate the past medical/financial history of a client. The below is a sample letter of what we might send to a client to address open issues that are found:<strong> </strong></p>
<p><strong>So that we might properly evaluate how best to address your corporate income tax return please let me know: </strong></p>
<p><strong>-What your unpaid payroll taxes as tax return showed $20,000.</strong></p>
<p><strong>-What the $10,000 negative Accrued Payroll account for. Accrued Payroll should show as a credit and this is showing as a debit. Please review/advise so that we might correct and amend this error.</strong></p>
<p><strong>-The Balance Sheet shows a balance of $4,000 of loans to you. Please confirm/advise if correct.</strong></p>
<p><strong>-The above are the only loans reflected on the company&#8217;s books and you had indicated when we met that you had other loans outstanding at that time. Please review and let me know total of other loans payable by vendor (and if they financed a particular item).</strong></p>
<p><strong>-Please let me know what the amount of the outstanding stock is of the company and what you paid by share so that we might record accordingly.</strong></p>
<p><strong>-Forward copies of your prior filed Personal Income Tax Returns</strong></p>
<p><strong>-Find out what the offsetting entry was for the $25,000 listed as a negative liability on the corporate income tax return.</strong></p>
<p><strong>-You had indicated that you had been paid no Shareholder Distributions yet your internal financial statement shows $25,000 being paid this year.</strong></p>
<p><strong>-If your prior accountant is almost done with your internal data, then I suggest you let them finish. If they cannot have within two to five workdays I suggest we do them.</strong></p>
<p><strong>-When I get the last financial done by your prior accountant please have them send to me open notes payable and amortization schedules and period end bank statements and bank reconciliation and a detailed fixed asset list detailing depreciation and accumulated depreciation by year.</strong></p>

<p>Don&#8217;t Delay When the IRS Comes Knocking; It Will Cost You More Than Just Extra Money</p>
<p>Do you remember the old car commercials of years back, when the auto mechanic would say &#8220;you can pay me a little bit now or more later&#8221;. Though the commercial ran decades ago, I have never forgotten the axiom. Similarly, I believe the medical community as well as Benjamin Franklin who teaches us that &#8220;an ounce of prevention is worth a pound of cure&#8221;. This is perhaps no truer than in the case of being sure that you both timely file and pay your income taxes. To help guide you in what to watch for, I will walk you through some of the common misconceptions about the U.S. tax system and dealing with the Internal Revenue Service.</p>
<p><strong>Common IRS Fallacies Taxpayers Fall Prey To</strong></p>
<p><strong>Constitutional Privilege. </strong>There are certain radical sects who have take the position that the IRS and its collection of income tax are unconstitutional. Nothing could be further from the truth. The IRS, like all governmental programs are initially organized and obtain their authority to collect taxes and indeed their laws to enforce from Congress/the President.</p>
<p><strong>Exempt.</strong> Frequently taxpayers will feel that their earnings either because of their legal status as resident aliens, individuals here on a Visa, illegal residents or students are exempt from the payment of income tax. Though there are many nuances with some of paying taxes as a student, such as whether you or your parents claim you, may vary, all people here in the U.S. are required to pay income taxes on their earnings. In fact, all U.S. citizens are resident aliens are required to pay income taxes on their world-wide income, regardless of what country the monies were earned in. For example, if you are a U.S. citizen but live and work in Italy, you are required by U.S. law to pay income taxes on all of your world-wide earnings regardless of whether you earned the money here or overseas. However, tax law does allow certain exemptions to certain countries based upon either IRS statutes or tax treaties allowing taxpayers to receive a credit or offset against your U.S. taxes to statutorily offset and reduce the U.S. taxes paid, thereby giving credit for monies earned and taxes paid overseas.</p>
<p><strong>Procrastination.</strong> If you fail to handle your responsibilities and duties, they do not go away in fact they most always get worse, not better. I spoke with a client recently whose tax obligations as a result of failure to file penalties, late payment penalties where their tax obligation had grown by almost a 100% over five years. Imagine what would happen today if you suddenly learned that you owed the IRS $15,000 for the current tax year. That, in and of itself, would be a difficult amount for any of us to address. However if we fail to file for several years and to pay the required taxes as they are due, then the $15,000 we might have otherwise have owed per year/years, will now grow exponentially as waiting has cost us dearly.</p>
<p>Don&#8217;t be led astray as there is no get rich schemes, no magic pills to take to either improve your cash flow or your credit, no legal tax schemes that create refunds out of thin air. By working closely with a CPA you are most apt to receive good counsel and ensure that you do not fun afoul of the Tax Man.</p>

<p>Working with the IRS in an honest open and straightforward basis is your best bet to ensure that your audit experience, to the extent that it can be, is an success. Frequently I see clients who are audited because they have a business and attempt to prepare their returns on their own. Tax law should never be attempted to be understood or appropriately applied by anyone other than a CPA who is well experienced and seasoned in such matters. Just as Believers we have an Intercessor to talk to God on our behalf so should clients retain a CPA to work to ensure that they pay only their lowest legal possible tax.</p>

<p>Having served Atlanta business owners as a CPA and helping them obtain financing for some thirty years we have seen some trends in the financial community come and go along with good times and in bad. However there are tried and true business issues that never go out of style. First and foremost, do not get a loan you cannot afford to pay back. Loans, should only be for a limited purpose and time frame and should not be a lifestyle or consistent financial means of running your business. Whether you need financing for business Acquisitions/Sales, Business Lines of Credit, Home Equity Lines, Factoring, Obtaining of Financing Proposals or need help you Negotiation of Bank Loans, Terms, Payoffs, Amortization, Calls &amp; Covenants, your CPA should be your first call to ensure wise financing decisions.</p>
<p>Obtaining financing is both an art and a science. Part of the process requires good record keeping, good tax advice, the right entity set-up, proper tax returns, good internal controls and much, much more. No lender wants to be subject to the whims of an business owner who is not taking care of the basics and his own shop. Care should be exercised in all levels of business management to be sure sound and proper business decisions are being reached on a daily basis along with ensuring that job costing is done on each and every invoice and that profit margins are being obtained and achieved.</p>
<p>Care should be further exercised that you have a good standing with your customers, the business community, employees and are a contributing member to both the social and moral fabric of your community. No banker or lender will desire to lend to someone who is not presently paying their current obligations or who are not aware of the many business and economic issues facing their company.</p>
<p>Work with a CPA who first looks to understand your business from the bottom up, by looking at all facets of your business. A prudent CPA should alongside you in your endeavors to succeed as an entrepreneur. A good CPA&#8217;s long-term goal is that you life, your business and your retirement are all better off as a result of their business relationship with your company.</p>
