Below is a sample letter one might use when addressing open and unpaid back taxes with the IRS. The goal of both the initial and all verbal and written communication with the IRS is to establish honest and open dialogue and to develop reasonable expectations for the taxpayer. Below is a sample letter that might be used when back tax returns are unpaid and to give the taxpayer time to pull their information together to submit an Offer in Compromise:

Internal Revenue Service, Atlanta, GA 39901 

I am following up on our conversation about the above referenced taxpayers and to confirm that you have placed a sixty collection hold on the account. 

I have went over the rules of an OIC (Offer in Compromise) and they appear to be an ideal candidate. Accordingly please cease all of your collection efforts while I work with the client to file their 2010 Corporate and Personal Income Tax Returns and submit and Offer in Compromise. Taxpayers have committed that they will be getting this information to me ASAP. Accordingly please suspend and cease all collection efforts for sixty days while this information is being pulled together, the corporate and personal income tax returns filed, and the paperwork for a Offer in Compromise submitted. 

Please do not pursue any further collection efforts while the taxpayers’ OIC  is being processed as it could both dramatically impair their ability to both fund the offer and to meet normal monthly living expenses. I look forward to working with you to address their open tax monies ASAP.

Please cease and suspend all collection efforts for sixty days while this Offer is being resubmitted.

Atlanta CPA on Addressing Back Taxes & Submitting an Offer in Compromise & Form 433A to the IRS 

Below is a sample letter we might receive from a client who is considering the submission of an Offer in Compromise to address their Atlanta Back Taxes. Coordination of the filing of returns, being sure you are current on your present/this year’s tax filings and payments is an essential part of the Offer and has to be done prior to an Offer of Compromise being forwarded to the IRS, as tax law requires it. 

I’m sorry we’ve been out of touch.  I’m not sure what’s been going on with my bookkeeper but she sort of dropped off the face of the earth recently.  I’m struggling to get caught up to where she left off with accounts receivable (which I’m finding has had nothing done since early January) and the bookkeeping (best I can tell hasn’t been updated since last month).  I’m having to go back and figure out where she left off and get caught up.

I’ve attached Form 433-A.  There are some things that haven’t been completed yet.  Before I spend much more time completing items and copying dozens of statements, etc. for backup, I want you to glance at it and advise on if we should continue to move forward based on the information included.   

Below is my response: 

To adequately do and submit and Offer and that attendant forms, it is most critical first to complete your 2009 corporate and personal returns. Otherwise we run the risk/likelihood of doing them twice as the information has to be current. 

ASAP after we get the corporate returns done then I suggest we get together and go over the Offer process and consider and evaluate all forms and the submission of an OIC (Offer in Compromise).

Atlanta CPA Teaches The Audit Process: Being Sure to Have Only Important & Requested Information Communicated to Your IRS Agent 

Frequently during the process of an audit taxpayers are desirous of telling their IRS auditors everything. Though a taxpayer will want to tell the IRS the whole truth and nothing but the truth, often times a taxpayer will share information that is not germane to the completion of the audit and the closing of the audit file. To this end if at all possible I do not take any of my tax clients along with me to the meetings with the IRS meetings as well as I am sure to only include information that is necessary, required and appropriate to assist the tax auditor in the process. Enclosed is a sample letter one might use: 

-Everywhere where you say each business name either list the company name in full or develop and define initials such as:  

A Sample Company, LLC (hereinafter called ASC, LLC)

Another Big Sample Company, Inc. (hereinafter called, ABSC, Inc.) 

-When you describe the “deal” between the companies detail it as a financial arrangement/business negotiation and then list the names of both companies. 

-Leave out any references to ABSC, Inc. financial results as they are not the company being audited.

 -Several times you make reference to both you personally and the LLC. All of these should be deleted and refer to ASC, LLC only, as only the LLC is being audited. 

-In the repayment process I would eliminate the word sporadically. 

-I would take out all references to his past signors on personal accounts as this is a business audit. 

-I suggest you have Medical Insurance Premiums deducted from the business bank account in future. 

-Delineate that/if capital credit card bill is used for business and what types of business expenses. 

-I would take off the reference to how data processed with your prior accountant.  

-There is no need to cover personal monies loaned back and forth personally as this is a business audit.

 -There is a need to document any personal loans made to a ASC, LLC and to document by promissory note any outstanding balances at each years-end by a signed agreement between all of the parties detailing the interest rate, payment terms and conditions.

IRS Audits: How to use a CPA During the IRS Appeals Process 

Finding an Tax Advocate/a CPA who is well versed in tax issues is your best offense to ensuring that you pay only your lowest legal possible tax. Retaining a wise CPA who has a track record of success is essential to being sure to only pay what you owe. Also, being careful not to listen to the counsel of others such as bankers, mortgage lenders, friends, workers or associates who are not CPA’s is a critical component of successful IRS dealings. There are many misnomers, erroneous beliefs, and rumors about how the IRS works and processes information. Your ability to steer clear of those who would lead you astray from the truth and a CPA who could otherwise do much to help protect our rights, continue your business and to maintain your household, as well as your sanity. 

Frequently when addressing an IRS audit we find that we are dealing with many issues concurrently such as back taxes, amending corporate and personal returns, and prospective advice to ensure that any past failures are not repeated. Many taxpayers whom I have represented in the Metro Atlanta area have been good teachable and coachable clients who were able to listen to wise counsel, tax law and to apply their tenants successfully.  Back Taxes 101…Helping Atlanta Taxpayers File Back Tax Returns for Decades

When addressing old back taxes and getting old returns filed and addressed, installment plans are great options for taxpayers who are not able to either qualify to submit an Offer in Compromise or to pay the tax in full, while asking the IRS for penalty abatement. Though these are often much better financial options, as they frequently result in a lower cash outlay, I have learned during the thirty years I have served Metro Atlanta Taxpayers that frequently the least expensive option is to pay the taxes and interest in full, while requesting abatement of previous tax penalties assessed. This option is for those who do not either meet the rules, guidelines and procedure for submitting an Offer in Compromise.

When addressing IRS tax issues and trying to evaluate between an Offer of Compromise or an Installment plan, frequently the options look bleak, as often they are. However there is good news for those who are desirous to look “outside the box” in looking to solve your IRS tax problems. Knowing the ins and outs of varying programs will do much to help you know what is in your best interest.

Installment plans are essentially long range, but are frequently the most convenient way to solve an IRS tax bill short term. However this option is frequently the worst option as interest and penalties continue to be assessed thus ensuring that you continue to owe even more additional monies rather than less. Form 9465 is used by taxpayers with the IRS to make an Installment Agreement Request to set up a monthly payment plan. If at all possible it is recommended that before you set up an installment plan, you look to other options available such as a loan from a bank.

Judicious concern should be taken to be a forward thinker when doing your cash flow and to plan long term to ensure that you will be able to fulfill the financial commitment you make in a Formal IRS Installment Plan. For example, if you owe taxes for the 2007 tax year and have not yet filed your 2008 returns and have not yet done adequate tax planning for 2009, setting up an Installment Plan with the IRS might be one of the worst things you can do. Care should be exercised to both, get all of your 2008 returns filed first and then to evaluate your 2009 taxable income to ensure that you will have the taxes and monies to pay all of the tax years in question. Failing to do so can be especially problematic as one of the rules of being on an Installment Plan is that you have to stay current on all of your filings and payments for the duration of the payment period, or the IRS will void the Installment Agreement and reinstate collection efforts. Considering all of these options allows you to have a much less problematic agreement and avoid unnecessary headaches, professional fees, and additional fines, penalties and interest.

If you owe the Internal Revenue Service less than $10,000 there is an option called a Guaranteed Installment Agreement. In general terms to qualify for this you have to have timely filed and paid all income tax returns for the last five years and have not used an installment agreement during this period.

Amounts owed the IRS of more than $10,000 then the plan is still available but the IRS may request additional information to determine and validate that you are not able to pay the present amount owed in full. As part of the Installment rules for all levels of IRS debt, the IRS expects you to file and pay all future tax filings on a timely basis. Failure to do so will immediately invalidate your Installment Agreement allowing the IRS to use liens, levies, and garnishments to effect and force collection. Typically to protect its financial interest in an Installment agreement the IRS will file a general lien necessitating taxpayers to get permission from the IRS in advance to either refinance or sale assets. Also, please note that the IRS will apply all monies as they see fit allowing dollars to be first applied to penalties and interest leaving the principal balance potentially unchanged.

Installment agreements are problematic because frequently there may be better options such as:

  • Pay the tax and interest in full. Frequently if you can do this and have valid reasons or explanations as to why the monies are in arrears, the IRS will abate assessed penalties.
  • Evaluation of old returns. Often I have worked with taxpayers to determine that original returns were either not filed, filed incorrectly or that valid deductions were originally left off the filed returns, and the potential amending thereof
  • Offer in Compromise. If you qualify the IRS will reduce your tax bill to a combination of your net worth and your “excess cash flows” over the next five years.

Representing yourself before the IRS is a recipe for disaster. Sitting down with a CPA who is well versed in tax representation issues is your best first step to getting back tax issues, payments and returns filed and paid. Finding the right solution to your tax problem helps resolve tax problems better and faster. Though an Installment Agreement is often the most convenient it often results in both prolonging the problem and the largest financial outlay.
