Atlanta CPA…Have You Just Received an IRS Notice?

Are You Looking for a Satisfactory Way to Address Back Open IRS Taxes? 

Understanding your options is your best option when evaluating how best to address open and unpaid IRS tax issues with the IRS. These articles and recaps will do much to help ensure that you make a wise a prudent choice. Having served as a Gwinnett CPA over a decade I have learned that the best option will always be to retain a CPA who is well versed in such matters and to ensure that you check all of their references.Paying the taxes and interest in full along with the interest while requesting abatement of the penalties. This has the advantage of stopping penalties and interest on any paid monies and the potential upside of perhaps a quicker resolution of the open monies. However this requires you to be able to source and full pay the taxes and interest, which may be require more capital than appears immediately available. However borrowing this money from a bank, friends or family might gain you a much lower carrying cost on the open monies and therefore be substantially financially advantageous.

Submitting an Offer in Compromise is a great option for those who qualify. In general terms to qualify you have to be up to date on all of your current tax filings and obligations and the amount you owe Will need to be more than the total of your net worth and excess cash flow over the next five years. If the IRS accepts your offer in compromise, you will be required to stay current on all personal and corporate tax obligations for the next five years. A typical Offer in Compromise will take between eight to fourteen months to process and you must meet the above criteria or the IRS will not consider your offer. For those who qualify the IRS will reduce the amount owed to what you can afford to pay, using the above, and then typically the IRS will look to have all of the monies paid ASAP after acceptance of the offer. Though the IRS can grant payment terms for up to two years on the monies, I recommend that all taxpayers pay in full, so as to limit any potential of non-payment and voiding of the Offer.

The third option that is most used to effectively address open IRS tax monies/back taxes is to set up an Installment Plan using IRS Form 9465. The Installment Plan, though often seen as a “quick fix” as taxpayers are able to get on a plan and begin making monthly payments, is frequently the most expensive option as penalties and interest continue to be assessed due and payable on any open monies.

A Financial Survivability Series: Taxpayers who do not file and pay their tax by the returns due date will be assessed a penalty. Penalties come in both as an assessment for failure to file and failure to pay. If you cannot pay all the taxes owed, you should still file your tax return and pursue payment options with the IRS. Penalties for filing late is five percent of the unpaid taxes for each month of part of a month that a return is late and will not exceed twenty-five percent of the taxpayer’s unpaid taxes. The failure-to-pay penalty is ½ of one percent of your unpaid taxes for each month or part of a month after the due date that the taxes are not paid. The IRS will consider penalty abatement for taxpayers who can show and prove reasonable cause.

The IRS has a Statute of Limitations to collect unpaid taxes is ten years from the date of the original return or the date of the assessment of the tax by the Internal Revenue Service. Please note that this statute does not start until either the return is filed or the tax year is assessed by the IRS, thus if you have not yet filed for tax years beyond ten years from today and the IRS has not yet assessed the tax year monies, the 10 Year Statute of Collections has not even started yet and the monies are still current, due and payable.

IRS Service Center Penalty Appeals Coordinator 

Enclosure: IRS Tax Notice dated 6-6-11 and my Letter dated 5-5-11 where I originally filed my power of attorney. 

Dear Sir or Madam, 

I am writing to appeal the findings as set out in the enclosed 6-6-11 IRS notice and I would like to request a face-to-face meeting to discuss the taxpayers circumstances and to go over the facts supporting what I believe is reasonable cause to abate all of the previously assessed penalties. 

I believe that our country are based upon the just and fair values of our forefathers and that forbearance should be offered to all to seek to comply with all of our tax laws. Accordingly I am writing to appeal the findings as set out in the enclosed 5-5-11 IRS notice and I would like to request a face-to-face meeting to discuss the taxpayers circumstances and to go over the facts supporting what I believe is reasonable cause to abate all of the previously assessed penalties. 

I am willing/eager to supply you with any information that you might need in order to process their file. Since I have assumed the role as their financial advisor, I have consulted with them, and in good faith have pulled together the information that you need to file and amend their returns to the correct balances owed.  

I am writing to appeal the findings as detailed in the previously forwarded letters and to request abatement for the penalties assessed for the 2010-2011 tax years. 

1. My name is John C. Dillard CPA of His CPA, PC and I have a power of attorney to represent the above clients. My address is 1940 Woods River Lane, Duluth GA 30097 and phone is 770 814 9304.

2. My EIN is 123-456-789. My clients SS #’s are listed above.

3. I want to appeal the original findings as the original assessment was incorrect and a signed amended return to reflect what is actually owed was filed and I would like to request a face-to-face meeting to discuss the taxpayers circumstances and to go over the facts supporting what I believe is reasonable cause to abate all of the previously assessed penalties.

4 & 5. The facts supporting our position are as follows: 

I am writing you in a good faith attempt to come to terms over the above taxpayers’ present predicament and to address their tax issues. I believe it is a just and fair request to abate all of the previously assessed penalties.   

At your earliest opportunity please call and confirm that the collection efforts have been stopped. The client sought out professionals who purported to be technically capable to properly file their return. As you can see from the clients attached affidavit, through no fault of their own, they were misled about what taxes were indeed truly due.  

Under penalties of perjury, I declare that the facts presented in my written protest, which are set out in the accompanying statement of facts, schedules and other statements are, to the best of my knowledge and belief, true, correct and complete. 

Based upon conversations with the client I have recapped and previously what they have advised that they have as their open tax monies. Please compare this to your records and advise as based on the above it appears that their tax monies have been overpaid by $10,000. 

I have previously forwarded an affidavit prepared by the taxpayer of the undue financial hardship being put on them as a result of this levy. As the taxpayers and the above indicate the taxpayer is in a refund mode please cease all collection efforts and not levy any monies until the above is adequately reconciled and addressed. 

I appreciate your attention to this matter and look forward to working with you to close their file.

If you can’t file today, be sure you file an Extension IRS form 4868/Application for Automatic Extension of Time To File U.S. Individual Income Tax Return.

Taxpayers are required to file their 2010 personal tax returns by 4-18-11. If for any reason you are not able to file your personal return/IRS Form 1040 by this due date taxpayers can file by the due date IRS form 4868/Application for Automatic Extension of Time To File U.S. Individual Income Tax Return. The form can be viewed at the IRS’s web site at http://www.irs.gov/pub/irs-pdf/f4868.pdf

Filing of Tax Extensions

The Application for Automatic Extension of Time To File U.S. Individual Income Tax Return is a legal way of notifying the IRS that you plan to file your return after the original due date.  This year’s due date is extended form 4-15 to 4-18-11 as a result of a holiday in Washington D.C.

The IRS allows a six month extension for both Personal Income Tax Returns, however please note that this is solely an extension of time to file and not an extension of time to pay and any late payments will result in assessments from both the IRS and state for penalties and interest. Please be advised that the penalties are even worse if you do not file the extension or the original return by the due date as the IRS can add failure to file penalties as well. These incentives are simply in place to give you time to file and pay.

Personal income tax return extensions are for six months and accordingly expire and there are no valid extensions available after this date.

Perhaps there is no greater area of tax law so complex and confusing. Our keep it simple style removes the shroud of confusion and assist those who want to avoid unnecessary penalties and interest.

Get an IRS Notice in the Mail? A Summons? A Garnishment? 

Proverbs 4:7  The beginning of wisdom is this: Get wisdom. Though it cost all you have, get understanding. 

God gives us guidance on how to respond to life’s opportunities as well as its problems.

The Top Two Tax Problems when dealing with IRS tax issues are: 

1. Addressing what caused the problem. Whether it be unwillingness/inability to file. Whether it be one of omission or of accident. Whether it be due to lack of retaining a good CPA or lack of knowledge. 

2. Failure to respond. Just this past month I have had clients receive garnishments and a Tax Summons as the IRS’s response to a taxpayer’s unwillingness to address a tax problem making a situation bad, much worse and limiting a taxpayers options to responding and reacting to IRS Enforced Collection Issues limiting your options to address back tax returns and unpaid tax liabilities.

So when that IRS notice arrives, look for a CPA to address your IRS representation issues. The below is a sample letter we might use to send to a client to begin the process of addressing IRS representation issues and to get all un-filed back tax returns, filed ASAP: 

We need to Get From You a Signed Power of Attorney/IRS Form 2848

Copy of the last filed corporate and personal income tax returns 

For all non-filed corporate tax returns copies of all filed payroll tax returns and recaps of all payments made by year. 

I suggest that we work to get all of the corporate returns filed first and then the personal as per your advice your are an S Corporation and file IRS Form 1120S. 

This is to confirm my advice that I suggest we do one tax year at a time. 

I suggest you commit to a firm timetable to get all of your non-filed corporate and personal returns done so that I might notify the IRS and GA accordingly. The smaller the time period you commit to and achieve the more apt we will be to avoid further forced collection issues.  I suggest a timetable of no longer than thirty to forty days.

Due to the volume of work to be done forwarding of a retainer, I suggest between one to three thousand. This is to confirm that all of our time will be billed at our standard hourly rate of $195/hour and that both the IRS and GA are substantially impaired by tax law to effectively address open tax monies (unless you opt to full pay) until all of your tax returns are filed and current. 

I suggest you recap your corporate data using an accounting package such as Quick-Books or if need be the form that is listed on the contact page of my website, while being sure to list the beginning and ending checkbook balance so you will be sure to have included all of the transactions that occurred in the business account.
