Alpharetta/Lawrenceville/Duluth GA CPA Asks…Have Old Tax Problems Immobilized You?

Alpharetta/Lawrenceville/Duluth GA CPA

Gotten an IRS Notice in the Mail and Don’t Know Where to Turn?

As a Faith Based/Christian CPA firm we know that there are enough details to worry about without having to worry is your CPA guiding you in the right path. At www.HisCPA.com you will find tax and business information you can use 24/7 to help you navigate the many tax details of operating and running your own business. The below is a sample letter we might send to a client to help them with addressing old back tax returns and filings. Be sure you work to keep your business in the black by working with a CPA who can help guide in all business management and tax issues.

Just touching based on your old back taxes.   I know that as you are working on them that it is both emotionally and financially draining.   I have learned over the years that working diligently and aggressively first on getting all of the old tax returns filed is the best step to getting the tax issues behind us.   For it is when we work to aggressively file the returns on our own that we run the lowest risk of having the IRS and GA pursue more aggressive collection efforts, garnishments, liens and levies.   Also both during the process of getting all of the old tax returns filed and then in seeking the best monetary solution it is frequently to work with friends and family as friendly lenders to be sure that you are best able to take advantage of financial opportunities/tax solutions presented.   Feel free to call at any time might you have any questions. Alpharetta/Suwanee/Lawrenceville CPA…Retaining a CPA is the Best First Step to Successful IRS Tax Representation

Alpharetta/Suwanee/Lawrenceville CPA…Retaining a CPA is the Best First Step to Successful IRS Tax Representation

Retaining a CPA is the Best First Step to Successful IRS Tax Representation. At His CPA PC we work hard to make sure that you pay only your lowest legal possible tax. Whether you have an error on your prior returns, need to amend a tax return, address back tax issues or submit an Offer in Compromise, we can help. The below is a sample letter we might sent to the IRS to begin the tax representation issue, while including an affidavit critiqued by us and prepared by the taxpayer:

Internal Revenue Service
Atlanta, GA

Enclosure: Power of Attorney

Dear Sir or Madam,

I am writing you in a good faith attempt to come to terms over the above taxpayers’ present predicament with the IRS, get their returns filed, and to address their tax issues.

I believe that asking that the penalties be abated is a just and fair request to abate all of the previously assessed penalties.

The taxpayers had no financial adviser in the past and they have retained me to assist them in this endeavor. At your earliest opportunity please call and confirm that the collection efforts have been stopped. As you can see from the clients attached affidavit, through no fault of their own, they were misled about what taxes were indeed truly due.

I believe the IRS is a just and fair institution whose goal is to assist those who are now attempting to comply with all of their current tax liabilities and has now a proven track record of doing so and that they have filed all of their returns, have corrected all returns filed in error by the filing of an amended return and have a current history of timely filing and payment.

Under penalties of perjury, I declare that the facts presented in my written protest, which are set out in the accompanying statement of facts, schedules and other statements are, to the best of my knowledge and belief, true, correct and complete.

Enclosed please find a check for $11,000 to pay the taxes and estimated interest and penalties in full. Please apply these monies as follows to the taxpayers IRS Form 1040 for 2011.

Original Tax                 $ 10.000
Interest                              1.000
Check Enclosed           $ 11.000

Please consider these facts and the taxpayers full payment of the taxes and interest and abate the previously assessed penalties.

I appreciate your attention to this matter and look forward to working with you to close their file.

Sincerely, John C. Dillard, CPA, PC, Partner in Charge

Snellville/Suwanee/Lawrenceville CPA..Does Your CPA Sit Down & Talk to You in Terms You Understand

At His CPA PC we feel each and every client has specific and unique issues and should be treated accordingly. The below is a sample letter we might send to a new client who has just incorporated their business in Georgia:

It was great to see you today. The below will recap our conversation:

-That you owe the IRS approximately $6K for 2009, $3K for 2010 and will owe approximately $12K for 2011 (based upon your estimate of netting $40K in your S Corporation).

-Please be sure to file your 2010 return by 10-15-11 and to forward me a copy when you do. I suggest that I do all of your personal returns in the future.

-That tax law requires you to pay a fair and reasonable salary given position and profit for your S corporation.

-You are going to use a payroll service and that I suggest you do a monthly payroll check.

-To be sure by the end of the year to have done at lease a salary to satisfy the IRS reasonable salary requirement.

-Please be sure to turn in a monthly expense report monthly for your business mileage.

-Please be sure to pay your medical insurance premiums of out the business.

-You are handing at present your issues with the IRS.

-That as soon as you can file a friendly lender to pay all of your taxes in full to sign a power of attorney to have me address the open taxes with the IRS.

-That as soon as your credit clears up to look to refinance to lower the 5% interest rate on your home.

His CPA PC believes that the best defense is a good understanding of tax law and having a CPA who anticipates your needs and works for your best advantage. Let’s get started today on planning your wise entity choices.

Alpharetta/Lawrenceville/Norcross CPA. . . This Week at His CPA We. . .

Helped a taxpayer file their IRS Form 1120S for their S Corporation Return, File IRS Form 1065 for their Partnership Return and IRS Form 1040 for their Personal Income Tax Return while being sure to:
-Record the ownership of their new partnership correctly.
-Advise and direct on tax law surrounding the deductibility for charitable contributions, being sure to list the values at flea market prices for household items and clothing given to charitable organizations.
-Advised on the tax advantages of converting their LLC, which is presently filed as part of their personal income tax return over to an S Corporation for tax purposes.
-Reduced my tax preparation fee on a client substantially to help them survive the continuing downturn in the economy.

Provided free tax advice to a taxpayer over the phone who is addressing back taxes and needs the advice of a CPA/IRS Representation while discussing options including an Installment Plan, Offer in Compromise or paying in full the taxes and interest to the IRS, while seeking abatement for penalties.

Continued in encouraging a client company’s president encouraging them set up a baseline minimum of internal controls/segregation of duties to protect business assets/cash balances.

Assisted a major bank and client to move dollars inadvertently made in the corporate name to one made in the shareholder’s name, thereby legally protecting a taxpayer’s assets from corporate liability.
Filed tax return for Limited Liability Companies that had converted to an S Corporation for tax purposes, while noting that an LLC will remain an LLC for all other legal liabilities.

Helped a new client determine which entity choice is the best selection for the new business.
Advised a taxpayer to file for their entity as an S Corporation by the filing of IRS Form 2553: Election by a Small Business Corporation being sure to follow the IRS Revenue procedures when the original deadline of March 15th is not met.

Worked with taxpayers to remind them that the final due date for the filing of personal income tax returns is October 15, 2011 and that there are no extensions beyond this date, while reminding them that an extension to file is not an extension to pay.

Discussed Penalty Abatement Issues with a Taxpayer facing a tax lien and IRS tax problems.
Advised a taxpayer that a rule of IRS Installment Agreements is that the taxpayer has to remain current in filing and payment on all future tax fillings or the Installment Agreement is voided.

Meeting with a business banker to network.
Worked with our Bible Study Group to set up serving the Lost, the Last and the Least in our community on Thanksgiving Day.
Met with a new client to help them with their personal tax return.

Wrote articles for the Christian Post, an on-line Christian web site.

Continued to work with a client needing to file several years of old back taxes for both their corporation and their personal income tax returns, reminding them of the need to file old back tax returns ASAP, hopefully before IRS collection efforts could cause great financial harm and difficulty.

Finished all tax returns where complete data was present within 24 hours, some even faster.
Assisted a taxpayer with issues for past amended returns.

Took time to talk to someone struggling to make major life choices. Stopped whatever I was doing in the middle of tax season to give a word of encouragement, while addressing management issues. Counseled my daughter on life/college choices. At His CPA, we believe your soul, heart and life are more important than work issues.

Followed up with present and new clients alike to ensure that their tax returns are correct, their questions are answered and that all tax returns were prepared ensuring that only their lowest legal possible tax was paid. Worked with the IRS to set up for Electronic Filing of Income Tax Returns.

Consulted with prospective clients for free to evaluate their tax return preparation and the tax effects of entity selection when incorporating their new business.
Consulted with prospective client to encourage them not to use a CPA for bookkeeping as a bookkeeper will be able to address routine issues at a reduced rate, leaving the CPA to handle more important strategic issues and corporate and personal income tax issues.
Updated our web-site at www.HisCPA.com with nuances on our tax preparation issues and placed articles on our blog. Posted several articles on www.LinkedIn.comAt His CPA we believe God made us all to be much more than just someone with a job, someone going to school or a pew sitter.

Alpharetta/Johns Creek/Duluth CPA…Are You Living in Faith?

You know the more I study Elijah the more envious I become of his faith. There are four obvious qualities he had that we all should try to develop in order to reach the level of faith that we desire. They are WITHOUT QUESTION, NO HESITATION, RECOGNIZING OPPORTUNITY, AND BOLDNESS.

I have a problem in knowing when God is speaking to me or if it just my wishful thinking. Elijah never seemed to have that problem. He knew when god was speaking to him. Whether it was prophesying or ministering, he never questioned God’s motives. His faith was so great that he knew if God was telling him to do something it was best for the greater cause and far beyond his ability to fathom God’s plans.

Elijah also acted on God’s commands with any hesitation. Regardless what the ramifications of his actions or circumstances God was putting him in, his faith that God was using him for the greater purpose was more important and he knew by his faith the Lord would be with him at all times. I can only pray for such faith.

You know the opportunity to minister to other is often right in front of us and we do not recognize it or if we do the opportunity has passed. Elijah always recognized his opportunities moved immediately to instill the Word of God in those who had never been exposed to the Lord or to bolster the faith in those who may need their faith revitalized. God presents us with these opportunities all the time but many times we either fail to recognize them or are not willing to take the time to do God’s work at the time. We should never pass on those opportunities and ask God for the strength, courage, and the right words to say when the opportunity arises. Finally, Elijah always moved on God’s direction with boldness. Whether marching into a kings throne room and warning them of their evil doings and the ramifications thereof or challenging those who threaten to take his life and the hundreds of worshipers of false gods. He knew by his faith that he had already won the challenge even before it started.

When you have true faith you cannot be a person sitting on the fence. You have to make a decision. Do you choose to be a slave of the worldly gods of materialism, power, position and so on, or do you choose to follow the Lord and build your Heavenly Treasures. As the Bible says, you cannot serve two masters. You either choose the worldly desires which lead to evil therefore permanent residence in Hell or choose the Lord’s path and receive your just rewards in His Kingdom. Sitting on the fence may seem to be safe but by doing so you are denying God. Have the faith of Elijah and move without question, hesitation, recognize the opportunities to serve and be bold in your actions. Praise the Lord!
