Norcross/Sandy Springs/Atlanta CPA Encourages Believers to Do Everything You Do as Doing it for the Very Glory of God…Taking Christianity Into the World

Colossians 3:23 Whatever you do, work at it with all your heart, as working for the Lord, not for men.

I had the unique opportunity to meet with two college age men today who had begun a new venture to not only help support themselves a bit but more importantly to be both “Eco-Friendly” and to Help Make a Difference in this World by sharing part of their efforts with others who are less fortunate throughout the world. I was not only honored by their presence but the ability to help donate back to our new generation by offering Godly wisdom, wise counsel and encouragement. For it is when we give back to others that we are most like Jesus Christa and can best answer the question: WWJD – What Would Jesus Do.

For me I have learned that the best ways I can do this is to be fully emotionally present where I am at all times, seek to always look to serve others by kindness and deed and to look to the best in others. For it is often in the simple things both said and unsaid where we  are most apt to lift up someone when they need it most. Below is a sample letter I might send after meeting a new associate to send both support and encouragement. So today I ask you….are you seeking all of the chances you have in your life to be like Him?

It was great meeting you and having a chance to talk with you about your business.  That was my first chance to attend a meeting and I thoroughly enjoyed it.  I met some really interesting people and hopefully made some good business contacts.  As I mentioned, I am a CPA and have over 30 years experience.  If you have or know anyone who has a need for a good, honest CPA with experience in all areas of accounting, please let me know or pass my contact information on.  I have a great website www.hiscpa.com that is full of really useful tax information that might help you and anybody you know with questions/concerns you might have regarding your taxes.  Hope to see you again soon at the next meeting.

Award Winning Results will be an asset for both your peace of mind and to help ensure you pay your lowest legal possible tax. I look forward to the opportunity to meeting and serving as your CPA for many years to come.

Lawrenceville/Snellville/Norcross CPA on Keeping Your Tax Returns Simple

Lawrenceville/Snellville/Norcross CPA on Keeping Your Tax Returns Simple

Pay Only Your Lowest Legal Possible Tax

The first page of Form 1040 is used to calculate the taxpayer’s adjusted gross income. While many people think of their income as what is reported on form W-2, there are some other additions (and possibly some deductions) that have to be made as well. Itemizing deductions on your personal return can result in paying a smaller tax. However the rules on what can be deducted and what can’t are fairly strict. Using a guide/CPA and a tax checklist are your first step to ensuring that an accurate fair and just return and to ensure that you pay only your lowest legal possible tax. Below is letter we might utilize to help a client ensure their returns are both complete and correct:

To complete your return I need for you to use the tax form I have on the contact page of my website to reflect your corporate data and make the below changes.

You did not show the $40K of Gross Wages on your recap that is on your personal W-2.

You did not show the beginning checkbook balance off of last year’s tax return of $7,000.

Please be sure to show your year-end checkbook balance while being sure that deposits plus beginning cash less expenditures equals the year end checkbook balance.

Please list the Tax you paid if payroll taxes as payroll taxes, otherwise please identify as to what it is.

Please put bank charges into office supplies. Keeping your chart of accounts current, up to date and usable are essential to good business & tax management.

There is no need to give me totals by individual month, just the totals for the year.

ASAP after I get the above I will complete the returns.

Please note I still need your husband’s W-2’s and copies of your cash contributions/tithing statements.

Alpharetta/Roswell/Atlanta CPA Encourages Believers to Seek Excellence in All That You Do…Taking Christianity Into the World

Alpharetta/Roswell/Atlanta CPA Encourages Believers to Seek Excellence in All That You Do…Taking Christianity Into the World

Staying away from  the most common pitfalls taxpayers make is critical to your personal financial success.  Careful discernment and wise application of tax law is an essential and critical part of avoiding otherwise avoidable IRS notices, penalties, responsibilities, IRS audits and amendment of prepared returns.

Colossians 3:23 Whatever you do, work at it with all your heart, as working for the Lord, not for men.

As a Body of Believers, we are commanded to give unto Caesar what is Caesar’s.  As such and based on the premise of the U.S. tax system, we as taxpayers are solely responsible for the initial filing of our returns and the fair and just filing of our lowest legal possible tax.  Avoiding these top pitfalls that many fall prey to will be an integral step in the proper preparation of your return. To assist taxpayers in the process it is the predominant role of the CPA adviser to be aware of tax law, details of changes from year to year and to ensure that not only a legally prepared return is completed but also that only the lowest legal possible tax is paid. The below is a sample inquiry that might be forwarded to an client to ensure not only a smooth tax preparation process but also that you best interests and tax law are always appropriately applied and considered:

For your Personal Return:

-I did not see any cash contributions for charities whereas you had some last year.

-Did you ever pay the state income taxes on the prior amended personal income tax returns as these will be deductible on Schedule A of your personal return as an itemized expense. Per my notes you owed GA $1000 for 2008 and that you are making monthly payments. Please confirm if this is what you are paying on. As the interest and penalties are not tax deductible, we need to prorate what State Tax has been paid. Please advise regarding the above and then when the payments started, monthly amount, when they will be complete and total to be paid total via state payment plan.

-Please use the below link for the valuation of your donated items to Goodwill and send to me detailed itemization reflecting these totals

http://docs.goodwill.org/alfresco/d/d/workspace/SpacesStore/36cf5260-0bd6-4eea-acfb-8a80e3e014b0/Donation_Valuation_Guide.pdf

-It initially appears as if we might be able to claim Earned Income Credit (for lower income years), which is a credit available if your children live with you full time and if you are the only one who can claim them. Please review/advise.

Tentatively it looks like that you will be due refunds from IRS of approx. $2500 and from GA $400. The larger refund from IRS is due to your lower income year and your possible qualifying for the Earned Income Credit. Please review advise.

Like our faith in God, prudent planning, wise application of the law and staying the course are always a judicious path to follow.

Hebrews 6:17-19  Because God wanted to make the unchanging nature of his purpose very clear to the heirs of what was promised, he confirmed it with an oath. God did this so that, by two unchangeable things in which it is impossible for God to lie, we who have fled to take hold of the hope offered to us may be greatly encouraged. We have this hope as an anchor for the soul, firm and secure.

Duluth/Alpharetta/Atlanta CPA on Top 10 Reasons Your Atlanta Business Should Retain A Christian Atlanta CPA

Every year the IRS selects approximately one to two percent of all tax returns filed. The U.S. tax system is a voluntary compliance system where it is a taxpayer’s responsibility to determine and file their accurate and just tax returns. In this process frequently taxpayers will create environments, which make the IRS more apt to review and audit a return. Your intent in filing a return should never be to stay away from or not deduct a valid deduction, however your end result should always be to file a return that is accurate and complete in all respects and for which you have adequate and clear documentation. By following these steps below you will find insight that will help you avoid unnecessary audits, additional time and stress, and additional assessments for interest and penalties. To take advantage of the Free Analysis of IRS Tax Audit you can contact John Dillard CPA of His CPA PC at www.HisCPA.com or call him today at 770.814.9304.

Duluth/Gwinnett/Atlanta CPA Advises Atlanta S Corporation Owners on Deducting Tax Losses

Tuesday, March 30th, 2010

Duluth/Gwinnett/Atlanta CPA Advises Atlanta S Corporation Owners on Deducting Tax Losses

Although there is no income tax paid by as S Corporation when the annual tax return is filed to the IRS. However, as a part of the corporate return which is prepared, a Form 1120S, there is an attached schedule which shows each owners respective ownership percentage and via a Form K-1 for which each shareholder should reflect on their personal return. K-1 profits, losses, and shareholder distributions are all required by tax law to be issued based upon the each shareholders ownership percentage. In order for losses to be deductible a shareholder has to have a positive tax basis, which is a component of past profits, losses, and loans to and from the business. If a shareholder has no basis to cover losses reported on a K-1, they are by tax law considered to be “suspended losses” and can be rolled forward to future years when the shareholder has positive basis, which can be created by future years profits or the shareholder loaning money to the business. Below is a sample letter we might send a client to ensure that to the extent legally possible, that tax basis is maintained in an S Corporation in order to take S Corporation losses:

Got the information you forwarded for your personal return and have already gotten started. Just wanted to confirm my understanding that the $50,000 Credit Line on the company books was done in the company name, rather in your name personally. Please advise/confirm. In the future if you have to get a loan to fund any business needs, if possible, get the loan in your name personally and then have you loan the monies to the business. That way you will have tax basis in the company that will allow us to deduct the losses as reflected on our 2009 K-1 and will not have to roll them forward to 2010/future year returns.

S Corporation  owner’s should report the K-1 profit, which is based upon their share of the business and not the amount of their shareholder distributions. This is a common misnomer about S Corporations and often leads to confusion for the new business owner. To that end it is best to remember that you pay taxes on the profits when you make them and not when you take them. For example generally speaking if your business nets $100,000 and you are the sole owner, you will pay taxes on $100,0000 whether you take zero dollar of shareholder distributions, a $100,000 or any number in between. Thus if you were to have a $100,000 profit in any given year and take no distributions then you would be able, absent any other issues, to take shareholder distributions in subsequent years with no additional tax responsibility as these monies would have already been taxed.

Alpharetta/Duluth/Gwinnett CPA Advises on Tracking Your Atlanta Business Financial Affairs

Thursday, March 25th, 2010

Alpharetta/Duluth/Gwinnett CPA Advises on Tracking Your Atlanta Business Financial Affairs

A Company’s Financial statements are often misused and abused. They are often ornately presented with accountant’s opinions ranging from audits to compilations. Often we even find a statement of cash flows and financial footnotes. What do these statements tell us? Numbers and data when prettily presented often are an accountant’s representation of the financial status of an entity.

I believe that financial statements without narratives, analysis of trends, and a review of expenditures are nothing more than formal proof that the bank account has been reconciled and that everything balances. Data without thorough critique is useless. Helping a business owner keep and maintain sound internal data and financial statements should be the predominant focus of the CPA. A Certified Public Accountant can do much to guide you to the proper chart of accounts, financial statement presentation and account classification. The below is a sample excerpt that we might forward a client to assist the business owner/entrepreneur in maintaining adequate books and records:

Please make these changes to you corporate books as of 12-31-09. These entries will reflect the adjustments/amendments we made to prior returns and the updates you gave me on the fixed asset schedule.

Debit Accumulated Amortization and Credit Accumulated Depreciation for $1000 to adjust your internal books to the detailed Fixed Asset Schedule.

Re-title the Account Accumulated Depreciation to Accum/Depr/Amort.

To record the new detail of the leasehold improvements you provided, to reflect past depreciation claimed and their transfer to the LLC please debit Leasehold Improvements for $70,000 Credit  Accumulated Depreciation for $30,000, and adjust your internal books to equal the Retained Earnings on the Tax Return by crediting the account for $40,000.

To record 2009 Depreciation Expense, Debit Depreciation Expense on the Profit & Loss and Credit  Accumulated Depreciation on the Balance Sheet for $16,000.

Atlanta/Alpharetta/Norcross CPA Teaches Atlanta Taxpayers How to Address Unpaid Income Taxes/Back Taxes

I recently got a letter from the IRS saying that I owe tens of thousands of dollars in back taxes . I remembered that I worked a job that that was a From 1099/Independent Contractor but forgot to pay for the taxes back for 2006 to 2009. I would like to know if its possible to pay for this in a monthly payment and maybe try to get the payment lowered. reason will I picked you guys is because your faith in our Lord Jesus. I am a Christen  and have made Christ  the Lord of my life. I would like to talk to you guys on the phone. Call me at any time.

Below is my response:

Setting up an Installment Agreement

Georgia/States & the  IRS will work with taxpayers to pay the monies owed over time. This option requires the taxpayer to file a form requesting that a specified amount be paid monthly over time. The IRS then has to accept the plan prior to it becoming effective. Though this is a practical way to address a larger balance over time it does not stop the assessment of penalties and interest which will continue to accrue until all monies are paid in full. Thus, it is most advantageous to consider procuring the funds from other sources as these finance/carrying charges are usually much less than that of the Internal Revenue Service.

Options for Penalty Abatement

The IRS can use a myriad of penalties and interest to encourage compliance, including information return penalties, non-filing, non-payment, estimated payment, and failure to deposit penalties. If you are assessed penalties for any reason you still have options. Both the IRS and states will work with you to address your outstanding taxes, interest, and penalties. One of the first defenses to explore is whether you have reasonable cause for your original failure to address you past returns and outstanding monies. If you are to be granted relief under these provisions you will need to be able to show that you have exercised ordinary business due diligence and care in calculating your tax obligations. You will need to be able to illustrate that obligations were generated when circumstances existed which were beyond your control contributed to the monies being owned and assessed.

Unfortunately the lack of knowledge of a law is not a valid defense that can be successfully used when attempting to request penalty abatement, as you are required to be prudent in addressing your obligations and responsibilities. Our tax system is one of voluntary compliance and tax penalties are the vehicle by which the IRS uses to ensure that you are financially motivated to file and pay your taxes as they become due. The IR S’s goal is to provide a consistent and fair methodology to assessing penalties to provide civil tax penalties to ensure ones tax obligations are satisfactorily addressed.

When evaluating penalty abatement issues the IRS will consider whether or not a penalty will cause a significant hardship such as a levy might impair a taxpayer’s ability to acquire needed medical care. As well a death, serious illness, or unavoidable absence may establish reasonable cause for considering penalty abatement. However items such as forgetfulness, ignorance of the law, and making a mistake are not generally allowed as reasonable cause in evaluating penalty abatement issues. The IRS will work with you to set up an installment agreement to pay outstanding monies as well as perhaps an Offer in Compromise if you qualify.
