Got the information you faxed over to complete your returns. To complete them  I need to know…

-How the year’s mileage should be prorated between your Corporation and your Proprietorship. Please be sure to turn in an expense report to get reimbursed for this in the future.

-Please forward the Balance Sheet for the Corporation. Please note I will always need this when you forward a Profit and Loss.

-Let me know what the type if insurance the business is breaking it out and labeling it accordingly in the future on the Profit and Loss.

-Will let you know the Adjusted Gross Income when returns done but will not know a good estimate until done.

-If you need a good net income estimate for 2012 for your corporation you will want to be sure that your Balance Sheet and Profit and Loss is correct and then to forward to me so that I might critique.

“Do others know that I am a disciple of Christ by the way I love?” Jesus has given us a “Love your brother policy”. This doesn’t just apply to that one hour you are in church on Sundays either! Does love penetrate out from you or would people describe you as easily agitated and annoyed? 1 Corinthians 13:4-8 teaches us what love is: Love is patient. Love is kind. It does not envy. It does not boast. It is not proud. It is not self-seeking. It is not rude. It is not easily angered and keeps no record of wrongs. It does not delight in evil but rejoices in the truth. It always protects, always trusts, always hopes, and always perseveres. Love never fails. Can you take out the word love in that entire passage and put your name there? Is Seven patient always? Does Seven keep record of wrongs? Etc. Be challenged this week in the way you love. God is love and His love is perfect. May people know you are a disciple of Christ by the way you love others this week!

News at the Garden…Serving the Homeless of Atlanta

We had a blessed week last week and even had a group from Liberty University join us for a short Fall break mission trip. We cleaned out our dining hall into the new storage container and started putting in a new serving line with cabinets. Many moved on from the ministry but again, we are already full by now. Continue to pray for us as the need is so great, especially with the cold months coming.

Saturday, October 15th, we are having a Blessed to Be a Blessing concert at 7pm here at the Garden. Come join us for a great night of worship and fellowship and if possible, bring some items like hats, gloves, socks, etc. for our brothers and sisters out on the streets! We look forward to worshiping with you!

October 30, we will be hosting our second annual Trunk-or-Treat at the Garden at 7pm. Come back your car in and pass out candy to our little ones(and probably some of the big ones too!) Hope to see you there!

I recently received a penalty abatement letter on a taxpayers prior personal income tax return. Tax penalty abatement letters are not handed out liberally and are only granted when appropriate. The process of gaining penalty abatement is a long and exhausting road, that once on settles on a course, cannot be pushed aside or easily distracted. The below is a sampling of a process that just resulted in gaining the IRS penalty abatement notice:

-Fourteen months ago I sent a letter to the IRS along with a check to pay the tax and interest in full while providing a reasonable basis for penalty abatement.

-Twelve months ago I sent a letter to the IRS to provide a copy of the amended tax return so that they might correct their records and the tax bill and requesting a Formal Appeal of the initial findings.

-Two months ago I sent to the IRS an Affidavit from the client detailing the facts and circumstances and as to why penalty abatement would be a prudent decision in this case.

-This past week receiving an letter from the IRS acknowledging that our request for penalty appeal has been granted.

Alpharetta/Johns Creek/Duluth CPA…Are You Living in Faith?

You know the more I study Elijah the more envious I become of his faith. There are four obvious qualities he had that we all should try to develop in order to reach the level of faith that we desire. They are WITHOUT QUESTION, NO HESITATION, RECOGNIZING OPPORTUNITY, AND BOLDNESS.

I have a problem in knowing when God is speaking to me or if it just my wishful thinking. Elijah never seemed to have that problem. He knew when god was speaking to him. Whether it was prophesying or ministering, he never questioned God’s motives. His faith was so great that he knew if God was telling him to do something it was best for the greater cause and far beyond his ability to fathom God’s plans.

Elijah also acted on God’s commands with any hesitation. Regardless what the ramifications of his actions or circumstances God was putting him in, his faith that God was using him for the greater purpose was more important and he knew by his faith the Lord would be with him at all times. I can only pray for such faith.

You know the opportunity to minister to other is often right in front of us and we do not recognize it or if we do the opportunity has passed. Elijah always recognized his opportunities moved immediately to instill the Word of God in those who had never been exposed to the Lord or to bolster the faith in those who may need their faith revitalized. God presents us with these opportunities all the time but many times we either fail to recognize them or are not willing to take the time to do God’s work at the time. We should never pass on those opportunities and ask God for the strength, courage, and the right words to say when the opportunity arises. Finally, Elijah always moved on God’s direction with boldness. Whether marching into a kings throne room and warning them of their evil doings and the ramifications thereof or challenging those who threaten to take his life and the hundreds of worshipers of false gods. He knew by his faith that he had already won the challenge even before it started.

When you have true faith you cannot be a person sitting on the fence. You have to make a decision. Do you choose to be a slave of the worldly gods of materialism, power, position and so on, or do you choose to follow the Lord and build your Heavenly Treasures. As the Bible says, you cannot serve two masters. You either choose the worldly desires which lead to evil therefore permanent residence in Hell or choose the Lord’s path and receive your just rewards in His Kingdom. Sitting on the fence may seem to be safe but by doing so you are denying God. Have the faith of Elijah and move without question, hesitation, recognize the opportunities to serve and be bold in your actions. Praise the Lord!

Multi State Reporting is not for the faint hearted or ill prepared and taxes a great amount of tax planning to be ready so that no undue surprises occur. The below is a sample letter we might send to a client to help them with their multi-state filing responsibilities when filing of their Corporate Income Tax Return or IRS Form 1120S:

Please be reminded that the IRS/GA/AL will assess late fees and interest for late payment. Your 2011 income grew substantially/doubled over that of 2010 with no substantive change in your withholding for the IRS, GA or AL. Please be reminded that I suggest that we tax plan at least twice annually.

This will confirm our advice that:

You should file corporate and personal income tax returns, business registrations and licenses in all states where you conduct business, have employees and/or a physical location. This includes tax law requirements that your reflect and show your wages and withholdings in the state where your/the W-2 wages were actually earned (i.e., if earned in AL, should show as AL wages and withholdings).

This is to confirm that you are handling all payroll and 1099 issues, your county property tax report, and your business license.

This is to confirm that you are aware of the need to have annual Board of Directors, Officers, and Shareholder’s Minutes meetings and that each year you should pay the annual fee with the Secretary of State’s Office to renew your corporations annual registration.

Please be reminded that you need to keep documentation of business miles by day by vehicle.

This is to confirm that you are aware that all active employee owners have to take a fair salary given their position and profit and that the IRS is a pay as you go system and that you are required to pay your taxes as you earn profits. Accordingly especially since you have multi-state reporting and taxation, I suggest that we tax plan at least twice annually.

As 2011 comes to an end, it’s time to think about what can be done to minimize the amount of taxes paid to the IRS by your business. Although tax planning should be a year-round process, there are several year-end strategies you can take, particularly if you are an S Corporation. The first step will be to ensure that your internal financial statements are properly compiled.

Proper tax planning requires we need to take a look at your financials to do some tax planning for the year. I have recapped below a list of the items we will need in order to properly evaluate and plan for your year-end taxes as well as address any year-end tax planning ideas. The below is a sample letter we might sent to a client to help guide and direct then in ensuring that that there are no tax surprises:

The IRS/GA and generally all states will add late payment fees and penalties for late payment.

In general terms to avoid this you need to either have…

Paid your taxes in full before the last day of the year…as long as pay via payroll withholding

Pay in 110% of your prior year’s tax bill…please note although your 2011 personal income tax return/IRS Form 1040 still reflected a net amount due…your 2011 withholding was substantially less so far than the approximate $8K of taxes due on the prior year return.
