Chapter 39

Feel the steel.
All he had wanted was a little time alone. Was that too much to ask. The library had always been his sanctuary. His place to relax. Everyone knew it. It was widely known and respected but why this night. Why today. He had gone in there for a nightcap, his usual brandy and then HE had walked in unannounced, unappreciated and not invited.
HE had walked in at a most opportune moment. Leaving the safety of his battalion of Secret Service Guards he strode in interrupting the evening’s respite. Just when all seems lost, a chance of a lifetime presents itself. President Jack Jackson, full of himself as always, a man on a mission.
Of self.
Without concern for those he stepped on or over. Without concern for those he hurt. Without concern for what meant most to the Chief Justice.
The Constitution of the United States of America.
America the Free, Land of Liberty and Justice, Don’t Tread on Me. One Nation Under God. Not mere words but the legacy, the destiny of a nation. Not for one man alone but for hundreds of millions. United Under God. Pledging Allegiance to the Flag that Shone Brightly. A City on a Hill. The Leader of the Free World. The Rescuer of Nations. The Leading Democracy of All Time. My Country. Mine. Not Yours. It was never intended to be yours. It belongs to all free, God-fearing people. Your reign will not go down in infamy for it will go down in flames. And it will end.
NOW.
The nickel plated Glock was made for a purpose. Destined for a journey. Made as a means to an end. Death. Carefully aimed at the left temple of President Jack Jackson the hollow point bullet tore through his left temple and the front of his face, leaving nothing recognizable in its wake. He was dead before realizing he had even been shot, his body’s weight succumbing to gravity, it’s pull bringing him back to the ground, to which his body would now go.
From ashes to ashes, from dust to dust.
Certainly there would be a state funeral, there always was, but he knew he would not be alive to witness it. No way. Not now. His course of action had already determined his fate. There was nothing left to do.

When clearing out the personal effects of President Jack Jackson, these notes were found tucked away safely free from scrutiny or discovery.
Until now.
Locked deep away in the secrets of his heart, far away from public view and record was a an old chained smoke scarred cross, the only recognizable remnant from a Albany, Mississippi church fire where 87 souls were lost and not the 86 who were reportedly killed. The one lost soul, his mother, whose record would never be discovered, a lone white orphaned girl, recently of child, attending an all black church seeking respite from pain, finding none in a rural southern town that fateful day, September 2, 1968.
Her lone survivor, aptly given the last name of the county where his life began in a small rural Mississippi town, his secret forever hidden in the churches ashes. Jack Jackson seeking to fill the hole in his heart that was there since birth by inflicting his pain on others. Instead finding the end of his life with a gaping hole in his mind. Power, controlling his head, arising to the country’s highest office. President of the United States of America, only to fall from grace and favor.
Beneath a chained, smoke scarred, cross on a parchment of fine linen paper where the excerpts of rules, written in his own hand, which were seized in a raid in Dusseldorf Germany, in 1919.

The files were marked, “Communist Rules for Revolution”:
• ”Corrupt the young: get them away from religion. Get them interested in sex. Make them superficial; destroy their ruggedness.”
• ”Get control of all means of publicity. Get peoples’ minds off their government by focusing their attention on athletics, plays and other trivialities.”
• ”By encouraging government extravagance, destroy its credit; produce fear of inflation, rising prices and general discontent.”
• ”Divide people into hostile groups by constantly harping on controversial matters of no importance.”
• ”Destroy the peoples’ faith in their natural leaders by holding the latter up to contempt, ridicule . . ”
• ”Always preach true democracy; but seize power as fast and as ruthlessly as possible.”

Chapter 38

The 40 caliber Glock. It’s balance unsurpassed. It’s craftsmanship unequalled anywhere in the world. Made by Smith & Wesson but for one purpose.
Death.
Its glistening nickel plating was only one of very few made like it. Very difficult to buy initially and now even more rare. One of a select number to have survived to present day. A real collector’s item. One of a kind. Having never yet before been fired, it was meticulously maintained. It once was and still was a true work of art.
The hollow point bullets, rolled in his hand, made with a repressed vacant center for their effect upon impact; flattening, providing the desired result leveling flesh, organs and bones alike. Any such bullet fired from such a range, from a manmade instrument of death, would mostly surely provide their desired effect. With energy to spare, and then some.

He had always liked this room, Supreme Court Chief Justice William J. Banks eases back into his chair settling in one last time as he readies himself. It was in this very room where he had first began his career as a judge and it was here his career would end. The mahogany walls of his library softly bristle in the light of the single lamp. Granting the comfort of many past years use, offering respite, like that of an old friend. If it has to end, let it end here.
No better place.

At 1200 feet per second the 40 caliber hollow point found its intended mark. From this range there was no way he could miss. In mere milliseconds from the firing pin striking the bullet, it left the Glock’s muzzle in a flash of light, announcing its entrance into the dimly lit room quickly entering the left temple of his head. Made for destruction, the hollow point bullet tore through the grey matter of his brain leaving a swath an inch wide and mayhem in its wake.
There would be no autopsy, there was no need. Death came instantly and completely. There would be no open casket. No amount of repair would be possible, not with the left side of his head gone. By the time the bullet had exited the right side of his head the bullet flattening his sinews, sapping all strength, and vigor that had once been. His body fell hard to the floor thumping the wood floors head first as his body toppled, its life over and done.

He had always been a cautious man, measuring his responses, weighing his responses, there was nothing left to do. Financially he had left his wife of forty-five years in good shape, the house had been debt free for years and the final college payments for his children were made long ago. His pension and his nest egg secure, it was the only thing left to do. There were no other options. There was no Plan B. Often the hardest things to do in life, are the ones which are the worst and most tragic.
Hopefully his family would understand. What the world thought really didn’t matter. The only important thing to be done is what he had to do himself. Sometimes a man has to do what a man has to do. Hopefully he might find forgiveness, if not in this world, perhaps the next. Maybe even understanding. No, that was expecting too much. No one could truly ever understand.
He lived by the words, duty, honor, country. Trained in his youth in the armed services as a Marine he understood the calling to a higher standard. He always had. Everyone had said he had grown up before his time, but what would they say now. Always willing to stand up to others to do what was right to protect the innocent and the oppressed.
But what would they say now. Now that it was done. Now that he was done.
Decisions in life aren’t easy. They never are. Especially the tough ones. Sometimes in the thick of battle, decisive men had to rise up when others shirked away, unable to clearly see. Frequently the door of destiny beckons, calling one to further a cause to serve and for the benefit of others.
But now, what would they say now. He had always been a cautious man, measuring his responses, weighing his responses, there was nothing left to do.
Certainly there would be a state funeral, there always was, but he knew he would not be alive to witness it. No way. Not now. His course of action had already determined his fate.

Chapter 37

The Attorney General was added to the surveillance list even before he made it back to his office.
After all there was no big rush to get there and no hurry to act.
Don’t even know quite yet what to do.
The four cryptic words to the Bureau chief direct from the president were self-explanatory.
Watch the Attorney General.
No one. No, no one, will escape from getting their just due. They’ll all regret the day they dared to cross me.
Long believed to be a man of temperance, President Jackson had so far been able to hide his Achilles Heel’s well.
His temper.

Only one last step to be made. One measly step. I can do it myself. I don’t need anyone else. Congress is too unwieldy. The Supreme Court has already sealed their fate. They just don’t know it yet.
With the Supreme Court out of the way, their checks and balance eliminating the need for Congressional insight and approval would complete his tasks. Not yet done, but confidently arrogant. The president takes out the slip of paper he had carried with him since his inauguration and marked off T the final letter in the word Patriot representing the Teaching of democracy, while rapidly seizing power.

Not since President Truman’s standoff with General MacArthur had one so violently drawn a Presidents ire.
“I’ve had enough. That’s it. Summon Chief Justice Banks to my office. And I mean NOW,” the president roared to his aid. “I’m not going to wait on the Bureau to act, one more second. Bring the Chief Justice here now.”

When Chief Justice Banks got the president’s message, he knew it was over. Time previously an ally. Now it was all gone. Legal proceedings, briefs, rulings, legal arguments, drafting of opinions would all take time. Time he didn’t have. There is nothing left to do.
Picking up his hat, Chief Justice Banks headed out, but not to Capitol Hill.
No need to meet with a president who has clearly lost his mind.

Chapter 35

“I can’t believe it. There couldn’t be a better test case. If this wasn’t a nightmare of a battle from the very pit of hell, I’d have to say this was a dream come true. This case will cover most every clause of the First Amendment. Freedom of speech, the press, religion’s free exercise and the right to petition the government all gift wrapped, shipped express and delivery right to our front door,” Supreme Court Justice Dennis Rogers addresses the full court in private session.
But not so private for Big Brother is listening.
“Seems there is a small rural pastor in rural Illinois who did not take too kindly to the Federal Communications Commission denying his license to operate a small A.M. radio station. Seems like the president’s actions didn’t open a can of worms for this pastor, but a can full of snakes. He’s talking up more venom than a copperhead snake,” if the stakes weren’t so high they all would have laughed.
“Seems the pastor made a boat load of money from selling a three generation old family farm on land that is now zoned commercial and he is willing to spend it all to set things right. He retained and teamed up with a local attorney, and they are seeking to maintain their Constitutionally preserved rights. Seems the president’s religious speech put him way out over the ledge. I believe this one will be one the FCC would have preferred to let slip through the cracks. This old pastor will very soon have his due day in court,” Justice Rogers almost chuckled.
Almost. The stakes were too high to be funny.

“Mr. President. Mr. President,” his Senior Adviser Robert Craig rouses him from his sleep. “It’s on. We got them red handed. Despite their debugging efforts we were able to get one of our highest tech listening devices hidden safely away in the inner sanctum of the Supreme Court judges offices. We have it all recorded. You were right. The Supreme Court judges are all in conspiracy. We can have them all arrested today. Just say the word and it’s done. We’ve won.”
“I appreciate your hard work, diligence and results Mr. Craig but it’s not quite time yet to pull their noose tight. Granted we would have them on conspiracy charges with no problem at all, ending each and every one of their very fine careers, But this has become personal.”
Very personal.
“I want so much evidence when they pull their own cord tight, it will hang each and every one of them, with Honorable Chief Justice William J. Banks getting what’s coming his way first.”
Maybe even with my own two hands.

The Bureau chief himself called Gerald Myers, the lead investigator on the case, for a closed door session with just the two of them present. No witnesses. No one else would hear. No one else would know.
Deniable culpability. Two words made popular by a history of presidents past, making their entrance into mainstream thinking of all Americans. What happens behind closed doors can’t be known. And better can’t be proven.
“I think you have figured it out by know, this thing goes all the way to the top,” the Bureau chief began. “We have to keep a lid on this until the president himself is ready to take this thing public. Though the evidence to date is certainly damning. Easily affording us a conviction for all nine of the Supreme Court judges and most likely at least a few Federal District judges. This thing has gotten personal. The president wants for this thing to play itself out. All the way. He wants to bury them so deep, pushing up daisies will be so far out of their reach, they won’t be able to even think about it. Do I make myself clear?”
“Very clear sir. When we are done, sitting on the bench of their jail cell rather than the courts will be the only thing left for them to do. When we are done, we will have them so legally tied up, they’ll be gift wrapped, just like Christmas.”

Chapter 33

A direct frontal assault will draw the most ire and attention. Better to look to the more subtle approach.
Rome wasn’t built in a day. It didn’t fall in one, either.
The shortest distance between two points is frequently the fastest, but often the most painful. For what we might gain with force and sheer might, perhaps a more delicate approach would be better. Perhaps a flanking maneuver. A little give and go. Can’t stay on one path too long, still have work to do to complete the process. They say slow and steady will win the race and that patience is a virtue.
But not mine.

Flanking maneuvers. Long held as a bastion of creativity by generals of war and politicians alike. Akin to a boxer feigning a left jab and following up with a right cross ending the match. During the Civil War at the battle of Chancellorsville, General Lee knew he was grossly outnumbered by over two to one. He did not stand toe to toe to fight as the numbers were against him. Better to create a diversion. A little sleight of hand.
A magician would be proud. All we have to do is distract their attention and then pull a rabbit out of our hat.
General Lee, rather than fighting head-on, opted to divide his troops by two leaving him further disadvantaged from direct assault. Now with only one soldier to every four of the Union army. Instead Lee decided to send General Jackson and his troops around to the side of the Union forces in a brilliant flanking movement. Soon routing the surprised Union troops.
Don’t have to be bigger to win. Just smarter. Ask Goliath. A well trained mammoth against a shepherd boy..A little boy with a sling and a few pebbles. Who would have thought?

The oval office. A great place to plan.
Or scheme.
Other administrations have come and gone, but mine is here to stay.
We’ll need to get term limits overturned. Just a matter of time.
Bringing in my inner circle would surely make them feel good. Being a part. A vital component in the wheels of progress. Yeah right. I’ve already decided. If I needed their help I would have asked them. They have titles because it’s customary. But there’s only one leader here and the rest are minions. My minions. The only item left to determine, is their relative standings to each other. Perhaps important to them but not to me.
Flanking maneuvers. Ever changing, ever evolving, lest old and outdated methods be turned into a liability. History forgotten is doomed to repeat itself. Hmm…
It’s better to join them than beat them. Lead from out front, but with the ideals of theocracy: A government divinely led.

About you, his primary concern as we travel through this world to our destiny. Be sure you stay tuned to this exciting broadcast as we seek to know what we the citizens of these United States can do. America, the land of liberty. Founded on values of good people with challenges facing us at every turn. Join us tonight as President Jackson leads us ever forward.”

“And now live from the Oval Office in Washington D.C, we join President Jackson in a personal address to the nation.”
“Ladies and gentlemen I appreciate your joining me today as we begin to explore together our need as a people. Though many of my predecessors and prior administrations have hesitated to do so, I am moving forward, together with you. No longer will we be a people afraid to admit the truth. Our people are looking for a time to return America to the traditional values of her roots. Tonight is that night.”
“Our forbearers founded us to be a country under God and to escape the tyranny of others. Today we are going to return to the standard our Founding Fathers originally intended.  Hence forward, we will be a nation who not only aspires to the written word of our forefathers, but one who acts it out as well. The rights of students to prayer will be returned to our schools and God’s word to our lives for without belief in a higher purpose, there is none.”

The Religious Right and the Moral Majority roared their joyous approval.
Too excited to be astute. Like a kid at Christmas looking at the size of the boxes. Rather than what’s in them.
Liberals throughout America cringed. The man they have voted into office had turned against them.
Afraid their long battle to keep religion out of the halls of government was lost. Not realizing, it was just beginning.
The nine justices of the U.S. Supreme Court clenched their collective teeth.
If I had any doubts before, they are all gone now.
Two of the previously undecided federal district judges instantly made up their mind. Instantly joining the fray aligning themselves against the president.
Only taking but a bit to tip the pendulum of otherwise balanced scales.

President Jackson continues, “There will remain no national church in America, for religious freedom has long been a mainstay of our country. However, all Americans will remain free to find God in their own way, as we are all united as God’s children. I myself will be seeking God in all decisions, governmental, political and personal. For whatever we call God, we are all made in His image, free to choose as we will. To worship as we see fit. From this day forward, I will seek God’s will in all issues facing me in my presidency, so that together we might fulfill America’s destiny. Lean not on your own understanding but seek him in all that you do.”
Leaders will come preaching His word, but do not be felled by their wiles and snares seeking to entrap. A time will come when prophecy will be spoken, but not heard, by all those seeking the one true way.

The Religious Right and the Moral Majority rested in their great achievement.
Just like Julius Caesar on the Ides of March. The fifteenth of March. A day to die for.
Misguided liberals eternally confused and now so much the more so.
The nine justices of the U.S. Supreme Court clenched their collective teeth.
Get ready. The onslaught of cases brought before the highest court are about to grow. Exponentially. This is going to be harder and more challenging than I ever imagined.

President Jack Jackson pulls a single piece of paper out of his wallet and calmly marks off the R in Patriot.
Religion. Makes the people feel good. So let’s endorse it. So we can start to get our country from all of this Christian nonsense. We might even post the Ten Commandments in Lincoln’s room at the White House. Hah.
Let’s not go overboard.
Solely an ends to a means. Work the agenda. Close the loops. It’s working out just as planned. Over half-way there. Stay the course.

Chapter 32

The mass exodus of the Supreme Court justices was watched throughout the whole of the United States of America.

           Big brother at its finest. With two agents to every judge for a quick out and back, it was a surveillance piece of cake.

          Traveling from their home office in Washington D.C., each of the nine justices itineraries included different cities recruiting favor from federal district judges to whom each had the most exposure. Beseeching to use their relationship adding strength and merit to their cause. Having cases forwarded directly from the Federal District courts would do much to deflect mass media attention for as long as possible. There were no public announcements made of the trips. Solely another working day where the justices would not be reporting to their office. Not at all uncommon with an absence of cases scheduled for the day.

          Though absent from their offices in Washington D.C., their presence was well monitored from coast to coast. In the air. On the ground.

           Everywhere.

          Chief Justice Banks went to New York, his confidant Justice Danny Cain to Boston while the most dissenting of the liberal judges Dennis Rogers travels to Chicago. The six other judges traverse to other major metropolitan hubs where large federal district courtships exists, including Atlanta, Los Angeles, Houston, Dallas, Los Angeles and San Francisco. Watching their tracks as much as practical in building a determined, but undocumented alliance. A coalition with a common fate. But no contract. The less that was written, the better.

          Surprising everyone but himself, Justice Dennis Rogers trip to Chicago, met with the most favorable responses adding a confirmed ally to their cause. There he met a fellow alumni from law school, who was quick to grant him a meeting, and perhaps more rapidly joined the fray. Widely known as a federal district judge he was widely forecast to be a potential future nominee to the lands highest court. But with his addition to the battle, all that was about to change. So was his life.

          The two judges traveling to Los Angeles and San Francisco were met with scorn and bewilderment despite well rehearsed pleadings and citing of case law.

          California. Always the wild card. Been that way since the days of the Gold Rush in the 1840′s.

           Reaching the weighty pitch of their arguments and pleadings, words of treason were heard with threats to contact the Attorney General and the President of the United States himself. Only by quickly back peddling and the softening of their positioned intentions, their train wasn’t derailed even before it left the station.

          Chief Justice Banks had expected to be discovered soon enough, he did not want to lose the end game, well before it even gained wings. It was best not to approach anyone, regardless of power or capacity, who might be inclined against rather than for their clandestine efforts.

          You have to be able to get out of the dugout if you want to play in the game.

          Chief Justice Banks trip to New York and Justice Cain’s in Boston met with initial skepticism but soon followed with favorable responses and near commitments. Promising to give their plan appropriate due care and judicious consideration. Committing to talk again soon.

          All that really could be expected in the circumstances. Akin to asking for volunteers for a heroic mission where no one would safely return or be alive to see the parade afterwards. Leaving their heirs to collect their Bronze and Silver Star medals for bravery.

          The Federal District Judge in Chicago in step, two more likely joining from the northeast in both Boston and New York, two voting no from California, there would most likely be a split of the four remaining. Bringing their probable total confidants to five offering a strong base upon which to draw strength and put their plan into action.

          Alone in his library playing solitaire, calming his resolve and steeling his nerve. The battle lines drawn. The war began. Half the deck already played. He draws the Ace of Spades. Pondering.

          What if we’re wrong? What if the president is done with this travesty? What if we’re stopped before we place our full plan into action? What if we can’t reverse the past legislation? What else is the president hiding up his sleeve? What if we are all tried for treason? How will Congress respond, or will it just sit idly by?

           Again.

          What if some of our team bails? What if the few committed district judges don’t stay the course? What is the course? What is our destination? What is the hand already dealt us?

          The Ace of Spades still in his hand, he plays it where he believes it will have the best impact.

          The card in play. The die already cast. Nothing to do now, but put all of your cards out on the table and play out your hand.

          Just like poker. Usually the better hand wins but frequently  the better bluffer.

Chapter 31

Their rushed travel itinerary was no problem for Big Brother. Always ready to do their duty. Twenty four hours a day, seven days a week. Always on the case. With only nine justices of the Supreme Court to follow, it was a walk in the park. Planes had be procured and rerouted but that was no problem, not with dozens of planes and hundreds of agents ready and at your immediate disposal.  Ever since the terrorist attacks earlier in the century, policy and not privacy, ruled the information highway. With all but your closest private conversations monitored and evaluated. Cell phones, the Internet, all great tools to effectively communicate with each other, were the very objects of surveillance used to determine your every day whereabouts, likes, and dislikes.

          Letting Big Brother know exactly what you are doing, when and where. All in the name of modern technology. How convenient.

          Two agents per judge were initially assigned with round the clock surveillance and monitoring guaranteed. With plenty more agents available at an instant’s notice ready for immediate assignment and departure. There was no place on earth anyone could run or hide. No matter what anyone tried to do, there was no escape to their watchful eyes and prying curiosities.

          The Bureau began the long process of gathering intelligence. Orders were handed down by the president himself. But by the time it had reached the lead investigators desk, they were watered down and ferreted about so much no amount of laundering would lead a trace of evidence back to the initial orders granting.

          Just like taking candy from a baby.

          The lead investigator Gerald Myers had been a Bureau employee for over twenty years. A rising star fast in the making. Heavily recruited directly out the military, already acknowledged for his excellence achieving the rank of Major in the Army. Serving in the first Gulf War as a Military Policeman, Myers himself was the investigator who personally broke the back of a arms smuggling ring who was looking to sell to the highest bidder, regardless of side, enemy or ally. Successfully solving the case ending the failed efforts of his successor, turning a negative into a positive. His office now a model of performance and excellence in effort.

          Single handedly he had built a case cast iron tight. So much so that upon apprehension, the defendants, after some hastily prepared, repeated and fallible denials,  quickly acquiesce accepting a plea bargain. Looking to avoid a costly trial, and even longer jail terms.

          For even a criminal knows when the jig is up. Going down with the ship is for captains who hit icebergs.

          Myers, by his exemplary performance in fervent pursuit of justice did much to personally stop the slow, steady inventory leak of military hardware which had long plagued the Middle East war efforts. Helping to stop the arming of ill advised terrorist spreading their legacy of senseless terror and violence throughout the region.

          Major Myers as an M.P. soon became the standard by which all other investigators were measured. Becoming the bane of many who sought freedom of action and loftier behaviors than the law legally allowed.

          Widely decorated for his efforts in the military and even more so in the Bureau, Gerald Myers was a take charge leader admired by his superiors and direct reports alike. Having the reputation as one who would not take no for an answer, not even when seen solely as a delaying tactic. His prominence and presence continues as a case of true intrigue begins.

          Who’s seeking to know? Who’s watching who? What are they doing? Why are they doing it? What is their goal? How will they do it? How will we stop them? How long will it take? What is the danger? What is at stake? What resources will be required? How many man hours are required? How will be catch them? Will there be a trial? Will it be public? Will there be jail time? How many people are involved? How long has it been occurring? Are we ready? Are they ready for us? Is this a trap?  What’s their end game?

          There were only two questions that did not need ever be asked.

          What’s our budget? What are our limits?

          Answers to those questions were always the same. Money is not a concern. Results are required.

          There are no limits.

          Get the job done within the confines of the law or break it as much as need be. Just be sure to cover your tracks.

          Deniable culpability. Two words made popular by a history of presidents past. Concealing their involvement, knowledge and accountability. Great legal words, that work to hide the truth.

          Well taught, well disciplined and well heeled were Gerald Myer’s trademarks. With his legend still in its infancy, the stage set for the biggest investigation of his life. One that would make the political espionage, sabotage, surveillance, break-in and cover-up of Watergate seem like a walk in the park. A mere asterisk in history.

          For history forgotten, is doomed to repeat itself. Over and over. And over again.

Chapter 30

The trials within the trial now begins in earnest. Battle lines drawn. The only remaining task to fight the battles which lay ahead. Free from encumbering rules and guidelines, victory or defeat the only viable options. An impasse would be equally as devastating as a loss, the pendulum already negatively swung.

          Harder to stop a brush fire from spreading before the winds have sprung, than to put out the embers just begun.

          The nine Supreme Court Judges gather, as was their nature to frequently discuss, argue and debate cases resting before them. But this time their only action, their call and fate already unanimously agreed.

          “We need to be able to push the law to the fullest extent possible, and if need be to blur it a bit. Our first step will be to divide up and meet with as many friendly federal judges as possible and if possible each and every states Attorney General. As you all know, the U.S. Attorney General, Glen Hamilton, was appointed by President Jackson himself. Approaching him would be akin to taking out an ad declaring our intentions in national law journals. On that note we will pass on giving any early notice of warning to our adversaries. Make no mistake about it, we will be treading on thin ice each step of the way,” Chief Justice Banks began.

          “Privately seeking to bring federal cases before our purview, has never been done before. At least not to this magnitude nor this overtly. To help limit the amount of initial scrutiny, each of you will be assigned to federal judges whom you are most familiar. The Sixth Amendment to our Constitution promises to protect the rights of those accused of committing a crime. Promising a speedy, fair trial, ensuring that the rights of individuals are not trampled on in the purported name of justice. We will be seeking out cases already in the system granting their quick ascension to our front door. We will be deliberately, yet delicately, green lighting cases which will assuredly put the president’s regime on guard and soon afterward on notice. We will look for opportunities to thwart Jackson’s administration at every turn, legally of course,” his posturing not escaping the courts bended ears.

          “The recent Federal Trade Commission rulings restricting further the issuance of licensing our airwaves is but one of the first steps to limit free speech. We all know what is next gentlemen. The limiting and disappearing of our freedom. I will not be around nor will any of us if the building block of democracy fails. We must not be deterred or fail. Our initial focus will be to infuse the court system. Blurring the lines between civil and criminal cases so much one would think denying a just and fair license request is at a minimum, a misdemeanor. If not a felony. The balance of our case load will still need to continue as it always has to put on airs of indifference. As our workload  grows, the stakes will raise ever higher,” Banks continues.

          “We are well past the point of no return, gentlemen. From this point on, it does not matter how history remembers us. Whether as heroes of our times or a band of misguided thieves, seeking to steal the balance of power. No, make no mistake about it. We are risking it all. Our careers, our families and I believe even if we are successful, our lives.”

          Each of the justices of the supreme court, itineraries in hand, their destinations in plain view. But not their paths with the fate of a nation in hand. Soon battle lines would be well-known as Big Brother was already hard at work, fully aware of the flurry of closed meetings and the justices harried hectic travel schedule. The motions of surveillance and counter intelligence well into play.

          I know I didn’t appoint them so they might not be loyal to me. But they will be soon enough.

           A watchful president begins the process. Take it one step at a time. Watch them closely. Let them hang themselves. And then take it, all away. All the way. No prisoners. No stopping. No barriers. No exceptions.

          Laws are for sissies. And underachievers. The checks and balances in our system have just begun. My checks on your balance. They say justice is blind. If being blind will help the justices of the Supreme Court, maybe that’s just what they need.

          Calling for an immediate meeting in the White House’s Oval Office, they quickly reported the instant they were called. The Vice President Ben Campbell sat across the president’s desk and to his left. Senior Adviser, Robin Craig directly across the desk and Attorney General Glen Hamilton on his right. They had been busy at work when the president summoned their presence.

          As busy as puppets can be, anyway. Hard to do much on your own when others are controlling your strings.

          “Thanks for coming on such short notice.”

          Not that you had any choice. Unless you consider unemployment a viable choice.

        “I’ll get right to the point. It appears that for whatever reason all nine of our Supreme Court justices have been up to something over the past few days. They have been having closed door meetings both with and without Chief Justice Banks. Such meetings in the past were normal in terms of their ongoing deliberations of cases and the like, but these were peculiar in both their timing and subsequent events. It seems as if all of the justices have headed out for various parts of the country and at this moment are either in the air or have just landed at their destination cities. We will be monitoring both their activities, listening when we can, and gathering intelligence through all available means. ”

        And I mean all available means.

        “We have reason to believe they are looking to subterfuge our administration, but by what means we do not yet know. Until then we will be stepping up our efforts to pursue our policies at all levels and to establish our administration as one of the ages.”

        “Today I will be announcing to the country SAFE. Safe will not have teeth in a legal sense. But it is a call to all Americans regardless of economic, religious or cultural ties to join together as one to accomplish great things for our peoples and our country. I have outlined the programs in your handouts and I believe you are going to like what you see.”

        “SAFE will allow all Americans to focus on what unites us to minimize what divisions there might be. SAFE like CARE is an acronym. S represents Safety which will be afforded us when we all unite in a common purpose for certainly together we can do more than when divided. A illustrates the Acceptance that we need to have for each and every person and minority, regardless of upbringing, for it is when we accept others wholeheartedly, that we can move together as one to accomplish far greater things. F is for Fellowship for when we are willing to unite together behind a common goal, that we find the peace and support of others as we reach out to them, as they reach out to us. E is for Encouragement as we all need to seek to be cheerleaders supporting the rights and responsibilities of us all. Granting Nirvana for everyone.”

        “It is up to each and every one of us to do our part, to do what we might, to discover what we all can do to make our country great. SAFE will be our rallying cry and watchword.”

        “Tonight on the American News Network, I will personally announce SAFE to all Americans and the world and its power of unification. If early reports are any indication, this will be widely supported as a building block for our administration. People we are ready. The day is now and the time is ours. Let’s roll.”

        President Jackson pulls out the slip out of his pocket and marks off the T in Patriot standing for Together. Blind group obedience. Easier to get them to follow the same path when they all see the world alike.

Chapter 29

The second closed door meeting in as many days, began without their leader presiding, present or requested.

          “Gentlemen, as you well know yesterday was quite a shock for all of us. We have all lived through enough years and seen enough administrations come and go to know that the pendulum of time, power and politics continues to slide and will do so. Long after we are gone,” Supreme Court Justice Danny Cain opens the meeting with the other seven presiding members of the Supreme Court present. “I do not make light of the unique relationship I have had with the Chief Justice over the years. But to be honest with you all, yesterday’s announcement was a surprise to me as well.”

          “I’ll say,”  the most vocal and dissenting liberal judge on the Supreme Court Judge, Dennis Rogers stands. “What you are talking about is high treason against the United States of America. Mutiny of its highest form and certainly, if we are not successful, the demise of us all. Careers! You can forget that, we will spend the rest of our natural lives in a federal penitentiary. I don’t know if I am ready to throw it all away. We risk being recorded in history alongside Benedict Arnold, forever known as the Lost Nine. We can’t seriously even be considering this. Much less talking about it. Does Chief Justice Banks have any idea what he is asking us to do?”

          “I think he does. But that is where we need to be sure we carefully contemplate if we are ready and willing to pay the ultimate price, our careers and our legacy. Likely, if we fail, we will spend the rest of our lives behind bars serving time with many of those we sent there ourselves.”

          “That’s the most truthful thing I’ve heard to date. We are certainly well past the prime of our youth. I don’t know that I am prepared to risk spending the rest of my glory years in prison, it isn’t quite the type of retirement I planned for.”

          Might as well bring water boarding back.

          In all fairness, judges all knew the truth, Supreme Court Justice Dennis Rogers was frequently the proverbial tail that wagged the dog. It was common knowledge Chief Justice Banks led from out front. However it was Rogers, frequently both the court’s most radical liberal, who did much to help keep even a conservative court centered, balanced and in check. For without Yin, there would be no Yang. Absent North there would be no South. Two contrary opposing forces working against each other in unison, keeping the U.S. Supreme Court interconnected and interdependent. Causing each to accept the judicial wisdom of the other. Bringing a common baseline in the end. Providing prudent, well thought out, judgments their ultimate result.

          Graduating with highest meritorious honors from Harvard Law School, Chief Justice Rogers began his professional career with one of the most prestigious law firms in Washington, D.C. Recruited by firms throughout the nation, his goal of practicing law close to home and his Maryland roots was a dream come true. His choice of firms was one of Washington’s finest in the field of lobbying with clients ranging from the world biggest automakers, high tech and foreign countries, making up their well known, affluent, and yet highly confidential client list. With billing rates well exceeding those of even the most specialized of medical surgeons, the law firm was a cash cow gone wild.

          Seen as a rising star in his years at Harvard, Justice Rogers reputation continues to be built. His dedication and tenacity brought to bear all the power that lobbying money can buy. Within a few years, he was the youngest lawyer at the firm to ever be offered a partnership, which would have financially set him up for life. However, within mere days, he became the youngest lawyer ever to turn down a partnership at the firm. Hearing and answering the call to public service.

          Even a Washington D.C. attorney in politics can gain a conscience. Not likely. But it can happen.

          No job, but with a clean start, Justice Rogers seeks to help interpret the facts as well as the intent of the law. Working for the common good of all. Rather than the special interests of a deep pocketed, well financed few. Long able to quickly address the varied aspects of competing complex legal theories providing just rulings to particular cases. Justice Rogers would have been an asset no matter where he served. Delivering truth, fairness and prudence to social and legal questions alike. He was a natural judge. Soon gaining the respect of his peers, supporters and detractors alike.

          It was his wide appeal to the common man ultimately gaining national attention and respect. Then ultimately a nomination to the highest court of the land, rapid ratification by the U.S. Senate and a long earned seat on the Supreme Court of the United States of America.

          Two Republican Supreme Court judges stood adamant. Against. Chief Justice Rogers even more so, the votes weren’t looking favorable, with history hanging in the balance. Justice Rogers quietly reflected as the others verbally battled the repercussions of an alliance. Wrestling with their fate and their own destiny. Hanging in the balance.

          Now is the time for all good men to come to the aid of their country. An old typing exercise, because it had filled a seventy space line when you add a period, continues its resonate droning in his head over and over. Soon leading Justice Rogers along with the rest of the Supreme Court judges down an unknown path.

          One of no return.

          Never again would their lives be the same. Never again would their justice be muted. From now to eternity their path would be discussed for a millennium. Though still disparate in their methodology and steps, they were now all united as one.

          You are right President J.J. Jackson, “this time WE will.”
