Gwinnett/Duluth GA CPA Firm Advises on Steps to Ensure an Successful Offer in Compromise/IRS Representation Experience

For taxpayers who has run afoul of the IRS and is dealing with seemingly overwhelming tax issues, there are words of wisdom to successfully resolve your tax problems, how to pay your taxes on a timely basis by properly utilizing withholding, estimated payments, and extensions. Though there are many things we can do to help you avoid tax problems and unnecessary penalties, we can also help you discover the general guidelines and rules of how to qualify for and process an Offer in Compromise. This is a process where both the Internal Revenue Service and the State of Georgia will reduce your bill to what you can afford to pay based upon detailed tax regulations, procedures, and careful compliance.

It is imperative for the CPA to work closely a taxpayer to help resolve tax issues, penalties, back returns, liens, levies and garnishments. Our keep it simple style in dealing with technically difficult and sensitive issues are embodied in our ability to keep you well informed of the progress on your account as it works its way through the tax system. Call us today to be sure that all of your rights are protected and that you pay only your lowest legal possible tax. Below is a sample letter we might send to ensure that all are aware of the steps involved as well as collections issues that will be forthcoming form the IRS, in the event all of the individual steps are considered and done so on a timely basis:

I wanted to be sure you are aware of the issues at hand and correspondence to date:

-We initially met on  2-2-10 and discussed the urgency of filing all of your returns ASAP, getting your 2009 & 2010 tax payments current and submitting an Offer in Compromise, if you qualify, while going over IRS Form 433A, Form 433B and Form 656,

-On 2-15-10 I sent guidelines of the general rules and urgency of submitting an Offer in Compromise.

-On 2-22-10 I filed my Power of Attorney asking for time to file all of your returns and to file an Offer in Compromise.

-From 2-12-10 to 3-3-10 I see three separate pieces of correspondence as to you reminding of details and urgency to file Offer in Compromise, if you qualify ASAP.

-Met with you on 3-4-10 to discuss urgency of addressing unpaid taxes.

-This will confirm our discussions that you are aware of the need to pay your taxes as you go or the IRS will not even consider an Offer in Compromise.

-This will confirm our conversations that I suggest that ASAP after we complete the 2010 tax planning above that you retain a payroll service to pay/keep your taxes current.

I will send you under separate cover information about keeping your filings and tax payments current.

If you fail to meet the deadlines above I believe the IRS ASAP will:

-File Liens

-File Levies

-Seize Accounts/Assets

-Garnishment Income/W-2 wages.

Duluth GA  CPA on Fixing Back Taxes and Installment Plans with the IRS

Tax law for a layman is most difficult to understanding tax law and even harder yet to adequately to adequately interpret and apply it. To that end documentation, sound written and verbal communication are essential to ensuring that all involved in addressing sensitive tax issues are well informed and versed on the many nuances affecting individual tax decisions. Understanding the “ripple effects” of business/tax decisions is essential to successfully resolving back taxes/tax issues for Atlanta taxpayers. Below is a sample of the correspondence that might be sent to assist a taxpayer when considering setting up an Installment Plan with the IRS:

I am mailing to you a copy of the tax lien received along with a power of attorney and Installment Agreement Request. I am resending the Power of Attorney as one you faxed back left off  bottom of second page. I am resending the Installment Agreement Request as it is old and does not reflect 2009 taxes, which we should also list if you do not plan to pay in full.

I suggest that if at all possible that we do your 2009 returns ASAP and that you pay any and all 2009 amounts owed in full and then for us to do an installment agreement on just the 2007 and 2008 tax years.

Tucker/Norcross/Sandy Springs CPA Presents Pastor 7’s Heart…Serving the Homeless of Atlanta…Taking Christianity Into the World

Monday, February 15th, 2010

CPA Serving Tucker/Norcross/Sandy Springs Presents Pastor 7’s Heart…Serving the Homeless of Atlanta…Taking Christianity Into the World

I would like to start this week’s email with a question…..  If you had to choose would you rather be Samson or Samuel?? “And what shall I more say? for the time would fail me to tell of Gideon , and of Barak, and of Samson, and of Jephthae; of David also, and Samuel, and of the prophets. ” Hebrews 11:32

Samson and Samuel were both very much the same and very different. Both men were judges, anointed of God to lead Israel. Both took the vow of the Nazarite. Both fought the Philistines. Both men are included in Hebrews 11 and in God’s Hall of Fame. Samson, a man of incredible physical strength, was impetuous, carnal, lustful, driven by his appetites.  In his hunger for vengeance he plead with God to destroy not only the philistines, but also his own life. By way of contrast, Samuel, a man of incredible spiritual strength, was content to let God fight his battles for him. A man powerful in the word of prayer, he lead Israel back from the worship of dead idols to the living God. Samson’s confidence was in what God had given him; Samuel’s confidence was in what God could do through him.

In the flesh, Samson appears more attractive to many men. Alive, confident, he boldly sought to do great things for God. On the other hand Samuel was more quiet, somewhat reclusive, available as a channel for whatever God wanted to do. Although God called Samson great, those who emulate him have a problem. If God had not placed him in his Hall of fame, Samson’s carnal lifestyle would make you wonder if he was saved. Thus, he who follows Samson’s example must wait until the judgment for affirmation; those who know and love him cannot affirm his carnality. You have a better model in Samuel.

We are so in awe with God. All permits and contracts are signed and construction started today. I’m going to just keep allowing God to show how miraculous he is in all our lives. God is always right on time. I would like to say thank you for all your prayers, love , and support that is given.  May many blessings be poured out like a river upon your lives. God bless.

GO JESUS GO JESUS GO!  LOVE,  Pastor 7

Pastor 7 with 7 Bridges to Recovery is doing great things to Feed the Homeless of Atlanta while spreading the word of God. I suggest you go down and see what he is doing on the weekends to take the message to the streets of Atlanta. I believe he would be a great speaker to the whole congregation and Discipleship Groups as people are looking for opportunities to get real with their faith by being the very Hands and Feet of Jesus Christ.    You can read about his Ministry at http://www.7bridgestorecovery.org/home_page.html   We are actively involved in going and supporting Pastor 7 and the great work he is doing to Serve the Lost, the Last & the Least.

Atlanta CPA Provides Top Tax Tips for 2010 for Atlanta Taxpayers

Recently we have picked up several new accounts who were also business owners and therefore had substantially more than a taxpayer who predominantly had mortgage interest and charitable contributions. It is widely recommended that all business owners use a CPA who is well experienced with the nuances and tax reporting for small business owners and entrepreneurs. Below is a sampling of the types of issues that have occurred on those returns in elevating those situations to proper bookkeeping, recording and compliance with tax issues.

A C Corporation that can legally convert to an S Corporation to avoid the double taxation of filing as a C Corporation/Form 1120.

A contracting firm that is operating as a proprietorship rather than as an S Corporation thereby exposing all of their personal assets to any potential corporate liability/tort issues.

A filing of a proprietorship/Schedule C was inadvertently reported under the incorrect spouse.

Tax returns where the results of rental properties were not correctly reflected.

Personal tax returns where unreimbursed employee expenses were incorrectly reflected on a Schedule C.

Returns where taxes and penalties were not calculated and assessed for premature distributions form pension funds/401K/IRA.

Returns were depreciation was not reflected on returns for fixed assets purchased in prior years.

Returns where Section 179 Depreciation was not reflected/claimed.

Returns where business mileage is not recorded.

Returns where the Internal Financials, Balance Sheet and Profit and Loss statement listed substantive errors in both classification and amount.

Internal books and records where Interest Expense on Company Debt was not reflected and in error, charged to the Note Payable amount.

An individual who is buying, fixing up and flipping residential homes/rental property in their own name rather than in an LLC, exposing their personal net worth to business liability issues.

Award Winning Roswell/Sandy Springs CPA Advises  on Accounting and Bookkeeping for Your Atlanta Business

This is the third of a Series about how Atlanta Business Owners & Entrepreneurs can make sound Accounting & Bookkeeping Decisions to Both Track and Record their Business Assets, Liabilities, Income and Expenses.

To determine the future net worth of your business, a determined and insightful understanding of your Profit & Loss statement (P&L) is essential and critical. Though a balance sheet is a recap of what has happened to a business’s assets and liabilities to date, a P & L, if properly presented/managed/understood is a look into the company’s short as well as its long term viability. A businesses P & L essentially measures how well the business is utilizing company assets, personnel procedures and facilities in its effectiveness of serving customers while keeping a keen eye on profit maximization. By properly gathering and studying one’s operations and its corresponding P & L, one can learn much about a business which is useful for measuring rates of return, detecting both positive and negative trends, taking corrective action, and business valuation.

As with all ratios, care and attention should be given to evaluate them in light of company size, maturity, business climate and industry. Though there are many general rules of thumbs for a variety of different industries, there is no substitution for wise and judicious counsel of a wise and trusted business adviser/CPA. They will help evaluate these and many other nuances which make your particular circumstances, operating overhead and unique niche. Below is a sample letter we might use to help get the data we need to help a business owner as they take steps to correct errors in their internal books and records. Having served as an Atlanta CPA for decades, I know firsthand that the beginning to properly running and managing an Atlanta Business is to have Adequate Bookkeeping & Financial Statements that reflect actual operating results.

Alpharetta/Sandy Springs/Roswell/Grayson Christian CPA Serving Christ…By Serving Others

Recently we received an inquiry off of our website seeking work here in the Atlanta area. Though I was not able to offer her employment, I believe we are all called as part of the Body of Christ to look to the needs of others and to consider themselves better than ourselves. To this end, every time I hear a request from a client I look to see what I might do to be the hands and feet of Jesus Christ. Below is their inquiry:

Do you have a job opening at your company?  I am a Christian and am hoping to find a job as an accountant for a Christian company.  If there are no job openings are your company, can you give me any suggestions on how to look for a Christian company that I can work for as an accountant?

Here is my response:

Thanks for visiting www.HisCPA.com  We are a one man shop. however might I suggest you contact a CPA firm here in Duluth as they are a larger firm. If you do wind up moving here, give me a call so I might help introduce you to some of the better churches and mission opportunities in the area.

In the Matchless Name of Christ,

John Dillard CPA

What can you do today to reach out to someone in need, to touch a hurting soul, to be a friend to those who are suffering and to Serve the Lost, the Last and the Least, just as Jesus would.

Roswell/Sandy Springs/Alpharetta  CPA on How Family Members of all Ages Can Serve on Navajo Family Missions…Taking Christianity Into the Word

From time to time we all struggle to see what God would have us do on a Family Mission Trip. Especially on the first trip I wondered what would I say, what would I do and how would I and the message be received. Ultimately what I discovered was that God would guide my steps, my words and my actions and all I had to do was to show up, be humble, be who God made me to be and to simply love others. However it is also prudent to walk others what they might do on a Mission Trip to help them gain peace, provide comfort and security for the journey ahead. Below is a sample inquiry we might receive and their questions and answers detailing tasks and opportunities on a Mission Trip as we seek to be the Hands & Feet of Jesus Christ as we are  Taking Christianity Into the Word.

Had some questions from one of the mothers who is considering going on the trip and thought these were great questions/answers to share with the group and may help you in making your decision so wanted to pass them on.  We can discuss them further at our next meeting.

What is the likely place where an eight-year-old girl and an eleven-year-old boy would contribute?  What do you think they would be doing?  Most eight year olds are either helping in vacation bible school (being a crew leader helper or helping with snacks) or helping with the younger children.  At 11, depending on the number of 12-18 year olds that we have, they would be a co-crew leader, help with outdoor games or work with snacks.  I encourage you to talk with others who took young children last year and it is amazing to watch the children – they adapt far better than adults and jump in and help out wherever needed.

Are the sleeping accommodations separated by gender – is there a male house and a female house?  Or will we be together as a family? The sleeping accommodations are by gender…everyone houses together by gender usually with 10 people per house.

Besides the airfare and the $300 per person, are there any additional costs? None except the Navajo’s do bring their wares up to the school and sell them and you might want to purchase something.

If someone is self employed and his business usually requires that he check email at least twice a day, is there any type of internet access available?  We have internet access by logging onto the schools wireless network – not a problem – lots of business people go on this trip and conduct business from there.  Obviously, we encourage everyone to focus on the trip as much as possible but we are realistic about business needs that people have to attend to.

Do people bring electronics (cell phones, computers, etc.) which they use in the evening?  Our children have been asking us this question.  Along those same lines, is it safe to leave things such as computers, iPods, etc. in the house during the day or is there a high risk of theft?  We ask that parents not allow their children to bring any electronics… phones, game boys, etc.  We are encouraging team building and developing new relationships and that is definitely a distraction.  They don’t miss them (honestly, they don’t).  We lock the houses when no one is around and yes, it is safe.  We’ve never had a problem with theft. I wouldn’t leave things out in the open and would put them away before you leave the house though.

What time do we typically leave every morning to go to the reservation, and what time do we usually return in the evening? We are on the reservation the entire time – we never leave the reservation.  We usually have breakfast at 6:30 and then the vans leave to pick up the kids.  You can usually turn in at night whenever you like…we do activities at night but not late.  You will also be in a house with other mothers of young children so you won’t have to battle with people coming in and out at all times.

How far away are the houses where we are staying from where we would be working? They are right next door

This question is mostly from our children, but we are curious also.  What do we usually have for meals, and do we eat at the house or the reservation? Meals are things like…chicken, spaghetti, tacos, etc for dinner.  Breakfast is usually cereal, cinnamon rolls, etc and lunch is almost always sandwiches.  The food in the past has been incredible although our kitchen head is stepping down and we are now looking for someone to fill his incredibly large shoes.

Sandy Springs/Roswell CPA Tax Directory to Atlanta Business Owners

Tax Law encourages the Internal Revenue Service to work with taxpayers to cease all collection efforts during the process of submitting and processing an OIC (Offer in Compromise). It is essential for the CPA to gain and file a properly executed Power of Attorney to notify the IRS agent they are working on the account and to manage and communicate reasonable timetables and deadlines to complete the process. Below are a listing of articles and sources of information to address filing a successful Offer in Compromise with the IRS. It is recommended that all taxpayers who have back taxes, old tax returns to file, a business or open monies due the IRS to retain the services of a CPA who is well versed and experienced in such matters.
